Defence lawyer Camneron defended his client Percy Gadd alias Percy Murray, 21, of 679 Bathurst Street, Toronto, on a technicality. Stating that he had no sympathy for Gadd's. manner, he requested him to apologize in Open Court to Pickering Township Po- lice Constable Hal Leslie. Mr. Gadd pleaded flot guilty to the charge of creating a disturbance in a public glace; the Pickering Township Police Station. He was fined $75. or 15 days in jail. After being convicted and sentenced, Mr. Gadd was asked by his lawyer, "are you going to make an apology to the Officer in the Open Court?" Mr. Gadd turned to Constable Leslie and said, "I arn sorry sir." "I have no sympathy for my client for having spoken to a Police Officer in the manner he did, which can only be termed as being disgusting and disgusting it was," said Mr. Cameron. Pickering Township Constable Leslie testified that Gadd and his friends entered the Pickering Township Police Station in Dunbarton. While in the station Gadd directed obscene language towards Constables Leslie and Kolebnicak. He was asked that if he didn't have any business with people in the station to leave. At the conclusion of Judge Jermyn's ruling that a Police Station is a Public Place he found Gadd guiltY on the charge of creating a disturbance in- a public place through the use of obscene and profane language. Mr. Cameron then asked Gadd, "are you apologizing?" Gadd tuirned to Constable Leslie and said "I arn sorry, sir." The Officer rose from his place at the press table and accepted the apology. "This is just a littie bit different, it was a conditional discharge, not just the ordinary Probation," Provincial Court Judge Jermyn told George Tapp of Ajax. "You have failed to keep these conditions. I arn ordering the original charge to be brought back to the Court. You are to spend four days in jail- for disobeying the orders of this Court. It is about time you showed a littîe common sense." Tapp pleaded guilty to the charge of breach of probation. He had been placed on probation last August on a charge of theft. At that time he had been given a conditional discharge if he lived up to the terms of probation which would have given him "a dlean record." Later on in November, 1972, he was charged with obstructing a police off icer and placed on a nine rnonth probation with no curfew. 80 milligramns of alcohol per 100 millimetres of blood he was fined $200. or 20 days in jail, the'jail sentence to run concurrent to any previous sentence.
