Plese be generous.... precast concrete steps divorce Having left his wife, and having signed over to her, his rights to their marital property, a Whitby man has been denied a half share of their $90;000 home. In a decision that was released last week, the Ont- ario Court of Appeals upheld a contract that the couple made as part of a reconcilia- tion settlement, in 1972. After suspecting that her husband was having an affair, Edith Lotton, 39, testi- fied that she insisted that her, now estranged, hus- band, Glen Lotton, 40, sign over his share of their home. In 1976, Lotton, a high school teacher, moved out of the house leaving his wife with their son and daughter, ages 9 and 11. Mrs. Lotton sued for divor- ce alleging menatal cruelty while he counter-petition seeking the standard half share of all family assests under the 1978 Ontario Fami- ly Law. Reform Act. Thé trial judge in the original proceeding said that since both Lottons contribu- ted to buying the house and that the husband had contributed almost his entire income for the family and improvements to the propér- ty, it would be inequitable to deny him half of the property. "In signing it (the con- tract) he gave up what amounted to be the greater part of his life savings," Judge D. R. Shearer said. "In return he received very little. The Appeal Court ruled that the contract was binding and overuled the decision. Arthur M. Rodgers Arthur M. Rodgers, son of Mrs. Nancy Rodgers of High- land Creek and the late Mr. Rodgers received his master of Divinity degree at Convo- cation Exercises at Simcoe. Hall, University of Toronto, on May 10, 1979. Art resigned his teaching position with the Scarbo- rough board of education three years ago in order to pursue studies for the United Church ministry. He .,had taught school for twenty-five years, twenty-two of these being with the Scarborough Board of Education. He did field work in minis- try at Dunbarton-Fairport United Church in Pickering and Victoria Park United Church in Scarborough. He has been seryingthe Ryrtle United Church 'North of Whitby since September. Art, his wife Ruth, and their four children, Darlene, Laurie, Danny and Larry are well known in the Scarbo- rough-Toronto areas for their Ministry in song in nursing homes, hospitals, and churches. Art has accepted a call tO the Janetville Pastoral Charge south of Lindsay, where he will begin his duties in September.
