Forty swimmers from botlrteams consisting of both boys and girls will be competing for the trophy. The Iroquois Park Pool's aquatic staff will also be on hand to an- swer any questions con- cerning Red Cross, Royal Life or recrea- tional swim programs. Anyone interested in becoming a member of the swim will be able to do so at the Competitive Swim Booth that will be set up. Other pool related ac- tivites wll be the initia- tion of the facility's new hydraulic chair lift that was purchased earlier this year through a federal government grant at1 p.m. The Durham Regional Police Force's dive team will give a demon- stration of the various skills and techniques used in the sport of scuba diving, at 12:45 p.m. Marguerite Jack will also be on hand to demonstrate synchro- nized swimming at 12:30 p.m. From11a.m. to1 p.m. there will be various dis- plays and bake sales sponsored by various minor sports organiza- tions including rep- resentatives of girls' ringette, minor hockey, the Whitby Figure Skating Club and the Whitby Swim Club. During this time there will also be free popcorn and balloons for the children. At 4:30 p.m., the staff of the complex will be holding a wiener roast in the south parking lot of the facility. Hot dogs will sell for 40 cents each and orange drink will be 10 cents. There will also be Dixieland entertain- ment provided by a local group - The Music Factory. The highlight of the day will be two perform- ances of Stars on Ice at 2 and 8 p.m. Stars on Ice is simiîlar to the Ice Capades. Tickets for this event are available at varions locations in the town - including the Iroquois Park Complex - and cost $6 for adults and $4 for children un- der 12 and senior citizens. NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED as a By-law of The Corporation of the Town of Whitby by the Council thereof as follows: 1. That Section2 of By-law No. 2585 is hereby amended by adding the follow- ing subsections: (61a) "Pit" means a place where unconsolidated gravel, stone, sand, ear- th, clay, fill, minerai or other material is being or has been removed by means of an excavation to supply materials for construction, in- dustrial or manufacturing purposes, but does not include a wayside pit. (67b) "Quarry" means a place where consolidated rock has been or is being removed by means of an open excavation to supply material for construction, industrial or manufacturing purposes, but does not include a wayside quarry. (83a) "Wayside Pit" or "Wayside Quarry" means a temporary pit or quarry opened and used by a public road authority solely for the purpose of a particular project or contract of road construction and not located on the road right of way. (66a) "Public Road Authority" means Federal, Provincial, Regional or Municipal agencies, and includes any commission, board, authority or department established by such agency having juris- dict ion over a road. 2. Section 6 Section 6 of By-law No. 2585 is amended by adding the following sub- section: (25) P ts and Quarries îne making, establishment or operation of a pit or quarry within that portion of The Corporation of the Town of Whitby as defined in Schedule "A" to said By-law No. 2585 is hereby prohibited. (zub) "Wayside Pit" or "Wayside Quarry" means a temporary pit or quarry opened and used by a public road authority solely for the purpose of a particular project or contract qf road construction and not located on the road right of way. (zgc) "Public Road Authority" means Federal, Provincial, Regional or Municipal agencies, and includes any commission, board, authority or department established by such agency having juris- diction over a road. (ab) "An Aggregate Storage Area" means an area located on a pit or quarry property for the storage of sand, gravel, stone or other material extracted from a pit or quarry. 2. Section 3 Section 3(a)(i) of By-law 1784 is amended by adding the following addi- tional zone: Zone M-4 - Extractive Industrial 3. Section 4 Sectiori 4 of By-law No. 1784 is amended by adding the following addi- tional subsection: w) Pits and Quarries No person shall open, establish or operate a pit or quarry within the portion of The Corporation of the Town of Whitby as described in Schedule "B" to the said By-law No. 1784, except as expressly pro- vided for in the Extractive Industrial (M4) Zone of this By-law. 4. By-law 1784 is further amended by adding the following additional section, namely; Section 9A as follows: Section 9A Extractive Industrial (M4) Zone (1) Uses Permitted: No person shall within any M4 Zone use any lot, erect, alter or use any building or structure for any purpose, except one or more of the following M4 uses, namely; a) Residential Uses: prohibited b) Non-Residential Uses: i) an aggregate storage area; il) a pit and/or a quarry; iii) a portable processing plant. (2) Zone Provisions: No person shalh within any M4 Zone use any lot or erect, alter or use any building or structure, including a portable processing plant, or excavate any pit or quarry or maintain any aggregate storage area except in accordance with the following provisions: a) The location of any of the above-mentioned items in relation to the lot lines or any public highway shall be in accordance with the provisions of The Pits and Quarries Act, 1971 and the regu- lations made thereunder. b) In addition to the above provision: i) No building, portable processing plant or aggregate storage area shall be located within 90 metres of any dwelling house on any adjacent lands he!d under distinct and separate ownership from the ownership of the pit property and which dwelling house existed at the date of the passing of this By- law. ii) The maximum height of a portable processing plant shall not exceed 21.5 metres.
