Ross Batten asked for the referal saying that he wanted to take another look at it before it was passed. At Monday night's operations committee meeting, the bylaw was referred back to council for action after a move by Coun. Marcel, Brunelle to amend the bylaw so that an Ash- burn family could keep their farm animals was defeated. The Centre Ward councillor made the move after Louise Lyons of Myrtle St. W. in Ashburn said that, adopting the bylaw would mean a change in her family's lifestyle. She said they moved to Ashburn to enjoy that particular lifestyle. The Lyons keeps chickens and three pigs on their property and are not in violation of previous animal control measures although it was learnt that keeping these animals does violate the zoning bylaw. Lyons pointed out that their home, which is one the boundary of the hamlet, wasn't even considered part of Ash- burn until the recent Ashburn Secondary Plan was adopted by council. "We were not even in the hamlet until the study was- done," she said adding that people who live in a rural area should expect to be ex- posed to farm animals. However, Batten, who lives in Ashburn and represents the North Ward on council, said that he has received several complaints., But he also said that council was not deliberately trying to take the Lyons' animals away from them. "We are not trying to incorporate a bylaw that. deliberately gets rid of your animals," he said noting that the Lyons are the onlÿ people affected by the proposed measure in this way. "The reason I came to the country is being taken away from me," Lyons countered noting that only last year did the City of Toronto enact a measure similiar to the one being considered by the town. "And I'm not in the city, I'm in a little hamlet called Ash- burn." Batten opposed the exception Brunelle wan- ted to give the Lyons because he was afraid that it would set a precedent the town doesn't want to live with. "If we give the exem- ption, then we're going to be in a lot of trouble," he said, "I just feel now is the time to put the whole thing in place." However, Brunelle counted that giving the Lyons an exception is fair and reasonable con- sidering they had them prior to the bylaw being i bylaw passed. He also noted that council tends to shy away from pdssing "ex post facto" regulations. He also beieved that the Lyons would respond to complaints in a responsible manner. "I strongly suspect that if there was a problem, then they would do something aboutit," Brunelle said adding that the bylaw attempts to cover a lot of 'what if' situations. "This is made to cover an eventuality," he said. Coun. Joe Drumm (East Ward), also op- posed the bylaw saying that council had no business telling people what kinds of animals they should reasonably keep. The whole issue will return to council for a decision gt its meeting next Tuesday but without a recommen- dation from the operations committee.
