On May 17 an accident at the firrns' Burns St. E. plant spilt some 300 gallons of toxic chromium into the sewer system which caused part of the Cor- bett Creek Water Pollution Control Plant to be closed down for about five months. Herrema said that the companies have paid for the dlean-up of the plant and have given the region $100,000 to buy new dlean-up materials for the plant. These samples are being tested at a private laboratory in Toronto and should they show that the companies are complying with the bylaw, the region may not press the charges. Herrema says that the 169 charges are' the resuits of this latest samplings. "The odd day they're over, the next day they're dean," Herrema said. Since the companies were found guilty on 34 counts of violating the sewer use bylaw, new ownership has taken over and Herremia says the region is willing to let them prove them- selves before taking any further court action. "They've been very, very co-operative since the new ownership has come in," the chairman said.. "They're big polluters and we've proved that but we are prepared to work with the new owners. " The companies have also showed the region their intentions to com- ply with the environ- mental standards set by the region. "They have paid us our charges, they have paid for the clean-up and they have paid us our costs," Herrema said. However, if the com- pany continues to pollute the, sewer system, the region is fully prepared to charge them and take them to court. "We certainly aren't going to allow them to pollute the plant," Herrema said adding that if the companies continue to violate the bylaw "we'll throw the book at them. " 0f the 169 counts to date, 95 have been laid against Plastic Plating Co. Ltd. and 74 have been laid against Plastic Surface Finishers. They have been ac- cused by the region of allowing excessive amounts of *chromium, copper and nickel to be discharged into the region's sewer system. When large quantities of these metals are discharged into the system, they kili the bacteriai organisms used to treat organic waste at the plant, thus allowing raw sewage to be discharged into Lake Ontario. The region's decision to ailow the company to prove itself before proceeding with ad- ditional charges has come under attack from Oshawa Reg. Coun. Bruce McArthur who has charged that the whole affair "smacks of backroomism. ' However, Herrema has brushed aside McArthur's criticism. "If there was an Oshawa company in- volved, a different at- titude would be taken, he said. The chaîrman also points out that the region is working hard to attract new industry to the region, and he wants prospective in- vestors to know that Durham works with business, not against it. But, Herrema stressed, that won't prevent the companies fromn being charged if they don't dlean up their act. Mayor Bob Attersley says he supports the region's position noting that the final option is to closeý the plant and throw a large number of people out of work. " There has been some improvement," he said, "They're trying harder than they've ever tried before but the only other option is to close them Up.,, And that, the mayor added, is almost as bad as the current situation. .However, Attersley added he's not prepared to ailow them to con- tinue polluting the sewer system either. "We'li only take it 80 long, then we will close them ,up. " The companies have appeaied ail 34 of their previous conviction but according to a confiden- tial document submitted to Durham Regional Councii's management committee, they have offered to withdraw 15 of the appeais if the region allows the remaining 19. The document also said that the comfpanies are wiiling to pay ahl out- standing dlean-up costs up to $7,500 and make a $6,000 "contribution" to the sewer systemn as a goodwili gesture.
