Free Prese photo Operations committee approves one of two school crossing guards Whitby's operations committee approved a school crossing guard for Garden St. at the CPR tracks Monday night but turned down a guard' for the intersection of Anderson St. and Fredrick St./Bradley Dr. Public works department had recommended guards be turned down for both locations. "Trains are big enough and noisy enough not to sneak up on people but that Garden St. at the traclcs is on a curve and ids do play with trains. Kids also act differently when there is an adult around" said councillor Marcel Bruneli, approving the guatd. The department pointed out that supervision at a railway crossing does not faîl into the legal duties of a school crossing gu ard. "Despite the legal imperfection it is an effort we ought to make," said councillor Tom Edwards. Councillor Joe Bugelli, who was elected chairman of the operations committee Monday following a committee shuffle last week, said that by the hiring the Town puts the guard in a legal position. "The Town is damned if it does and damned if it doesn't," said Bugelli, noting the Town could be held liable if an accident occurs at the intersection after a guard is hired. He also said the Town could be held liable if an accident occurs at the tracks without a guard because the Town knew of the area have to go a quarter-mile out1 of their way, committeeX maintained the intersection on a four-lane street was hazardous for a guard. The public works departinent, in recommending against the guards, noted there is now a crossing guard at Anderson and Manning Rd. and lights will be placed at the intersection in November. The department said it would be much safer for children to go out of their way and cross at the lights. Committee agreed. "To consider putting children and guards there (Anderson and danger. 'T~rain time there is anytime. They go through on a supply and demand basis," said Harris, noting that a similar intersection on Park Rd. S. in Oshawa has had two guards at the location for the past 15 years. "Oshawa has shown compassion and common sense. I behieve Whitby is just as compassionate, if not more," said Harris. In moving approval of the guard, Edwards suggested only one guard be placed at the trac. despite a department comment that three should be hired (one on each side of the track and a standby guard should one be absent). Residents in the Fredrick StiAnderson St. area did not get approval for their crossing guard. Both recommendations will go before council nextMonday night.
