Commencing April 1, oversized containers cannot ho used for residential garbage collection, Town council votedlvlonday. Failure to comply will resuit in residents not having their jar- bagre collected, council decide. Council's action was prompted hy. a request from the public works department. Director Wayne Hancock told council the department has encourtered problems as a result of collectors handling oversized containers. . Collectors have heen injured while trying to manoeuvre the awkward containers, Hancock said. According to a staff report, Whithy's garbage bylaw specifles that trash containers should not exceed 30 in. in he'Ight and 50 lhs. in weight when fi lied. But during the past two years many homeowners have heen using oversized plastic con- tainers that exceed hoth limits. Due to their excessive capa- city, the containers are often loaded heyond the 50-lb. limit making it diflicult for them to ho ernptied since there are no grips to facilitate lifting, the report states. "We've had several cases of back injuries due to the weight and strain," Hancock noted. In 1991,1 letters were sent to retailers asking them not to selI the containers and the manufac- turer was advised of the pro- duct's deficiencies, the report states. The letters had littie effect, the report adds, while the majority of residents using the containers ignoéd or refused to co-operate ithr a requost to discontinue their use. Hancock said the department does not object to people using the containers to carry their gar- bage to the curhside. But they must remove the garbage ha g themselve;s, collec- tors will no longer do it, he said. First-time offenders will be gen a letter advising them of t he Town's new policy, Hancock said. The second tirne it happons a stîcker will ho slapped on the container wnrning that it will not be emptied, he said. "The third time it won't ho picked up," l-ancock added. Councillor Don Mitchell said he appreciated the department's concerns, but felt the penalty is too severe. "I find this a little heavy- handed,» said Mitchell. "I dont see the problem of lifting a hag out and putting it in the garhage truck...this is not rocket science."1 Mitchell said many people, du e to shift work or oth or reasons, must leave their garbage out al night. But this can cause problems if animais get at thie unprotccted bagis, he said. Cêouncillor Dennis Fox suppor- ted the decision. "We're not talking one house or one can, there could be 800 houses ... that's aJ ot of bending," said Fox. "We can't expect people to un- Ioad garbage cans over 3 ft. in height. We h ave to be fair."
