Residents witl fight town 's K-Martdecis ionat 0MB Kendalwood Road residents who opposed the building of a restaurant at the K-Mart Plaza are con- sidering not only a protest to the Ontario Municipal Board but a consumer boycott as well after the restaurant was approved by Whitby Town Council at their regular meeting last week. Bll Lovelock, a spokesman for the residents, said that they will have met before press time to con- sider a plan of action. "We more than likely wilI be going to the 0MB, " Lovelock said after the meeting. "We more than likely will be going to the 0MB," Lovelock said after the meeting. "We will have to talk it over with the people; but what have we got to lose - nothing. " Lovelock said that he wil have "about 1,000 flyers" printed asking people to boycott Dominion Stores. "We will see what their stand is then, " he said. "It is the people who have to sup- port the store. " Area residents had asked that the restaurant be moved frorn the north-east to the north-west corner of the lot since the former location caused problems for them. The move was vetoed by Dominion Stores which refused to allow the restaurant - to be operated by Winco Steak and Burger - su close to its store. Dominion has the authority to veto any develupment in the plan. Lovelock was "more than disappointed" with East Ward Councillor Jue Baby contest The Whitby Jaycettes are sponsoring a Spring Baby Photo Contest, as a ways project for their organization. Only the first 50 snapshots, 3" x 5", one child per photo, will be ac- cepted. Babies under three years old by December 31, 1979 are eligible for entry. Entry forms can be picked up at Whitby and Brooklin banks and Manchester Credit Union in Whitby and Brooklin. Closing date for entries is April 11. Containers will accompany each photo and a penny dropped in t.he container registers one vote. The top three babies will be presented with bank savings certificates. Drumm, who represents the area, because Drumm voted for the plan as presented, with the restaurant in the north-east corner. The plan would have died should Drumm have voted no as it was carried by a 4 to 3 vote. "He (Drumrn> was aware of the problems we were having with Dominion Stores," Lovelock said. "I think he should have given us the benefit of the doubt. " In defending his yes vote, Drumm said that not to have dune so would have been "moralIly dishonest. " Drumm said that assurances were given by the developer that the developrnent would cause the residents no problems and the town had no reason to doubt the developer. "I know I arn going to get kicked in the head by the people down there, " Drumm said. "But I don't care whether the people jump on my back; I think I arn morally right. " The restaurant received council's approval along with the expansion of the existing plaza after atteni- pts to have it tabled or referred back to committee failed. Giving the nod to the proposai were Drumrn, Nor- th Ward Councillor Bob Car- son, Centre Ward Councillor Barry Evens and Mayor Jim Gartshore. Opposition came from West Ward Councillor Joe Bugelli and regional coun- cillors Bob Attersley and Gerry Emm. The 0MB has already received objections to the proposal from uone developer with an interest in the near- by Whitby Mail at Thickson Road and Dundas Street. Also during council's debate, residents learned that the town has no say over the closing hours of the proposed restaurant. The town's administrative committee told residents last week that the restaurant would be allowed to remain open after 10: 30 p.rn. The hours'of operation can only be controlled by the Liquor Licensing Board of Ontario. Mayor Jim Gartshore said that the restaurant's closing hours could be discussed when it applies for a liquor license. The restaurant will cater to about 200 people and will employ a staff of 80.
