DELIVER FOR A NOMINAL CHARGE -- Three Men Found Guilty Of Conspiracy To Defraud Public A Toronto man who orchestrated a million dollar vacation property swindle has been sentenced, in absentia, to three years and six months in prison after pleading guilty earlier to a charge of conspiracy to defraud the public. Tomas Reinis, 28, formerly of 103 Pittman Cres., Downsview, failed to appear in provincial court today for sentencing. He had been free on $12,000 bail since the conclusion of a preliminary trial in November, 1984, at which he and two other men each plead guilty to a charge of conspiracy to defraud the public. Gerald Clarke, 32, of Oakville, a manager and sales agent with companies operated by Reinis, was sentenced to nine months in jail and fined $5,000 after pleading guilty to a charge of conspiracy to defraud the public. Michael Kennedy, 30, of Scarborough, a sales agent working for Reinis, was sentenced to nine months in jail after pleading guilty to an identical charge. A warrant of committal has been issued for Reinis and he could face further charges as a result of his failure to appear and breach of bail while at large. Reinis was the director of four companies which lured people into buying or placing deposits of between $500 and $1,000 on marginal or worthless worthless land in the Muskoka, Haliburton and Kawartha areas, by showing them quality vacation property which was misrepresented as the land for sale. In other cases, purchasers were led to believe there was easy road access to the property they were buying or that building permits were readily available when in fact the property was often landlocked or construction was prohibited by local zoning. During the three-week preliminary trial in the fall of 1984, more than 30 victims testified to buying land they were not shown or could not use. Loss to consumers is estimated at more than $1 million. Many victims lost their life savings or committed themselves for years to comë to paying mortgages on worthless property. The companies owned by Reinis operated out of offices in Metropolitan Toronto and used advertisements in the classified section of local Toronto papers to attract their victims. To obtain land, Reinis, or his associates, would scan local real estate listings in vacation areas, looking for inexpensive property which they would purchase once they had a prospective buyer in Toronto. Before being shown properties in vacation areas, victims were often required to make a cash deposit and after seeing a certain property were confronted with a hard sell and urged to buy immediately. Victims were often encouraged to use an in- house lawyer, recommended by the company, to save time and money. Complaints from a number of people who felt they had been bilked by the land sales operation led to a year long, joint-investigation by the Ministry of Consumer and Commercial Relations and Metropolitan Toronto Police. That investigation resulted in 24 fraud charges being laid against Reinis, Kennedy, Clarke and the four companies in September, 1983. Additional charges were laid in April, 1984. All but the conspiracy to defraud the public charges were withdrawn when the three accused elected to plead guilty at the conclusion of the preliminary trial. "This was a shoddy and heartless operation which acted without concern for the victims or their families. They drew the fish into their nets and then the sharks attacked," said John McWatt, an investigator with the Ministry of Consumer and Commercial Relations, who was involved in uncovering the land swindle. "This was the largest investigation and conviction involving this kind of fraud operating on such a widespread basis," said Staff Sgt. Neil McMillan of the Metro Toronto Police. The Ministry of Consumer and Commercial Relations and Metro Toronto Police are continuing to investigate between 20 and 30 other companies suspected of operating similar vacation •property swindles. Consumers are warned to be extremely cautious in their dealings with unregistered land sales agents.
