Jesse Owen Gray, 24, received eight knife wounds.-- including one to the heart that caused his chest to fill with blood -- during the fight June 8, 2002, prosecutor John Scott said during his opening address Monday at the trial of Cary Cleyndert, 20, of Scugog. Mr. Cleyndert has pleaded not guilty to second-degree murder in the death of Mr. Gray, of Mussulman Lake in York Region. Court. heard Mr. Gray and Mr. Cleyndert were among more than 500 revellers at the annual, organized field party for graduating students of Uxbridge High School and other north Durham schools. ' , The deadly clash occurred after Mr. Cleyndert. began "bugging" several girls, including the victim's girlfriend Mellissa Bell, near a stage located on the property at Zephyr Road and 4th Concession, court was told. "A rude comment was said to me... I. told him to f-- off and we walked (away)," Ms; Bell testified yesterday in Superior Court. "He came back over to where we were... We didn't want him there but he wouldn't leave," Ms. Bell said. One of her friends splashed a drink 1 on Mr. Cleyndert, and lie responded by "spitting on both of us," • the Crown witness said. Mr. Cleyndert walked away and Ms. Bell told her boyfriend, Mr. Gray, about what happened. 'Mr. Cleyndert chose to have a knife, a knife he could conceal in one hand, a knife that he could open with one hand,' --Crown prosecutor John Scott "Jesse came over and asked what was wrong. I said, 'This guy has been bugging us. The guy in the brown leather coat had spit on us,"' she said. Mi: Cleyndert raised his arms above the crowd of people "pointing himself out" and Mr. Gray went over to confront confront the defendant, Ms. Bell said. As the fight broke out a circle formed around'the pair, blocking her view. The next time she saw Mr. Gray he was lying bleeding on the ground lifeless. Mr. Scott said the fight between "two big men" broke out shortly after 4 a.m. as music blared from speakers and partygoers danced and consumed alco hol and some drugs. "Gray came to the fight with only his hands... Mr. Cleyndert chose to rely upon his hidden weapon," he said. Witnesses saw Mr. Gray throwing punches at Mr. Clcyndert's head and Mr. Cleyndert hitting back in an "underhand "underhand direction," said Mr. Scott. Mr. Gray fell to the ground, struggled struggled to his feet and kept on fighting until he collapsed again, court was told. "What does Mr. Cleyndert do? He fleés," said the Crown, adding the accused accused made his way to the road and offered offered someone money for a ride. He was arrested at the scene when a police officer stopped a group of party- ers standing near the road asked to see their hands. "Mr. Cleyndert produces his hands and there's blood on them," said Mr. Scott, adding there was also blood on his shirt. Mr. Scott said the case "comes down to the choices made by Mr. Cleyndert. "Mr. Cleyndert chose to have a knife, a knife he could conceal in one hand, a knife that he could open with one hand. "He chose to attend the party with that knife," he said. Prior to the party, Mr. Cleyndert allegedly allegedly showed off the butterfly knife to several friends, telling them it was for "protection," Mr. Scott said. Court heard Mr. Gray consumed some alcohol, marijuana and cocaine at the party. However, "He chose to go (to the party) unarmed," said the Crown.
