Nick Katsiapia of the New Dutch Oven, just north ofOrono is ready for the new smoking by- law that takes effect next Tuesday. Offence Act, is a summons Smoking Continued from front DURHAM RLGION HEALTH DEPARTMENT cv 'oS»o^ Ontario public places and work places was adopted by Regional Council in December of 2002 after much public consultation. consultation. Over the past six to nine months the Health Department Department has been involved in a vigorous campaign making business owners aware of the requirements of the new bylaw. bylaw. "We estimate 95 per cent of workplaces and public places will be voluntarily compliant, many are looking forward to the ban," said Goreman. "There are a small percentage of businesses that we will have to bring into compliance," he stated. Infractions of the new bylaw bylaw after June first can be called into the Region's Health Department at 1-800- 841-2729 Ext. 2188 or by visiting visiting the Region's web site www.region.durham.on.ca. Names will be kept confidential, confidential, says Goreman. An inspection of the complaint will be carried out by the smoking by-law enforcement officers. "In the protocol we have developed for enforcement enforcement officers, there may be some dispensation, depending on the nature of the offence." stated Goreman. Establishments Establishments that do not come into compliance of the by-law will be chaired under part one of the Provincial Offences Act. A ticket much like a parking or speeding ticket will be issued with a set fine of $200, "You either pay the ticket or got to court and have your say," said Goreman. Part Two of the Provincial and you must go to court, the maximum find under this section section is $5,000 according to Goreman. "We may do that for someone who refuses to be compliant or someone who has a history," he said. Exemptions to the by-law can be found in bingo halls, racetracks and casinos, which are permitted to have a designated designated smoking room which can take up no more than half the occupiable public space. Private clubs such as the Legion, may still allow smoking smoking if it has no employees and if the general public is not allowed in the facility. An effort to exempt homes for the aged from by-law in some parts of the Region is as yet unsuccessful. Because nursing homes are 'home' to their residents there is a feeling feeling that designated smoking rooms should be provided. As nursing homes are also work places and the intention of the ban is to protect workers workers from second hand smoke, Glendene Collins, a spokes person for the Durham Region Health Department, said the by law will not be changed to accommodate seniors. The Region of Durham will use World "No Tobacco Day" an event organized by the World Health Organization to focus on the harmful impact that tobacco has on world health, on May 31st to celebrate the approaching approaching smoke free by-law. 1 -VL SERVING DURHAM REGION SINCE 1841 all funeral services PREARRANGED AND/OR PREPAID BURIAL - CREMATION - TRANSFERS "WHERE PROFESSIONAL ETIQUETTE IS IMPORTANT' FUNERAL DIRECTORS PAUL R.
