| The Fight Going The following from the Montreal Star will read with considerable intefest and it may be profitable ' HE LICAYSED VICTUALLERS AND THE GOVERNMENT, On. 4 phe following is a synopsis of the ex parte "dny of June, on the complaint of Raphael petition of Theophile Rapin, innkeeper, which was heard by 'His Fonor, Justice Johnson to-day. It was presented by Messrs. Kerr & Carter, counsel for the' Licensed Victuallers, Mr. Rapin, it will' remembered, was the party selected by the Association to test the law on the subject of licenses. ~ Mr. Rapin was summoned on the 13(h Bellemare, Inspector of Licenses, that Rapin had failed to take out a license. Rapin was fined $85 and costs by Mr. Des~ noyers, P. M., in the Court of Special Scs- sions. To-day the petition for a writ of prohibition was heard, and the following reasons given why Rapin should not be fined. 1st. That there is uo Act of the Legislature of the Province of Quebec which authorizes the said compalint and prosecu- tion. 2nd. That the pretended Act of the Tegisture upon which such prosecution is founded is not an Act of the Legislature of this Province, but purports to be enacted by Her Majesty the Queen, when she had no right or title to pass Acts binding the Pro- vince of Quebec, but that it was not passed by those gifted with legislature powers in the Province ; that the said Act purports to treat of and regulate criminal procedure, and because in the penal clauses the punish- ment is by fine and imprisonment, It then goes on to say that the Court of Special Sessions had no juisdiction to try the case, nor the Police magistrate any authority {o summens the petitioner for the pretended offence, and' that the pretended Act intitul- ed "The Quebec License Law of 1878," under which the said prosecution was insti- tuted, is entirely illegal, and tbat as the Police Magistrate had unfawfully taken juisdiction over the petitioner, he had found it necessary to apply for a writ of pro hibition. Judge Johnson granted the writ and it will be served on Police Magistrate Desnoyers this afternoon, DOBBINS' ELECTRIC SOAP.
