The evidence brought out these . facts: Bushby purchased from Darcy a team 'of horses, a set of harness and a cart for $130. He had them two weeks 'when a constable took them away on a warrant, as they proved to have been stolen from Price & Sons, of Hamilton. "Darcy had purchased the outfit in an auction sale at Port Perry, the same day he sold it to Buseby. The man who stole the team had disposed of them at this sale, pur- porting to be the owner, He was subsequently arrested and sent to the "pen" for five years. Bushby sued for the return of the purchase price, 'and $50 damages for inconvenience suffer ed, and for care of one of the horses which was sick most of the time. The horse became frightened and unmanageable at its approach, and finally made a spring which brought the buggy in 'sharp contact with a telegraph post. = At that moment the shafts gave way, and the horse leaped forward dragging Mr Ford over the front of the buggy and some thirty yards beyoud.
