Agreements of Purchase and Sale, Mortgage Financing Documents when signed, form a binding contract full of legal language few of us are trained to understand. Realtors have training and experience in drawing up Agreements of Purchase and Sale and will help you understand its contents, however, a lawyer can help wade through the "legalese" that accompanies most documents to ensure that your rights and interests are fully protected. A lawyer plays an important part in the home buying process. Don't be intimidated by the aura that surrounds the legal profession. Rely on your lawyer's services and guidance and ask questions if you don't understand something. They are there to make sure problems are anticipated and prevented before the transaction os completed - not later, when you're sitting in your new home. Lawyers are paid according to services provided not on whether the transaction is . completed or not. Therefore it is a good idea to discuss with your prospective lawyer about their Real Estate experience, how they structure their fees and ask for an estimate of other legal costs you can expect. Find out what services they will provide for the fee, how are they equipped to cope with problems if they develop and are they available after hours, when most offers are signed. Ultimately, you'll weigh their responses against your own gut feelings about their attitude and willingness to help you. Don't let fees be the only deciding factor. There is often no relationship between fees and experience. Go with the lawyer who has the right experience and is genuinely interested in providing professional service. After your search and you've found the home you want to buy, consider having your lawyer review your offer to make sure it is legally complete and accurate. Once an agreement is accepted 'between yourself and the seller, your lawyer will begin their duties; - Check and ensure that you will have valid title to the property and that it is described correctly in every document. - Determining if there are any claims registered against the property and clearing them before you take title. Verifying with the municipality what taxes are sowed, zoning and that present use is legal. - Calculating the amount of Land Transfer Tax you will be required to pay, as well as any adjustments necessary to compensate the seller for prepaid fuel (in oil tanks), taxes and utility bills. Drawing up mortgage documents. Remember, going fishing with your lawyer doesn't mean that they have to be the bait. (Mark Smithuis a Port Perry real estate broker and immediate Past President of the Oshawa and District Real Estate Board.) Gord Mills, MPP named assistant Premier Bob Rae announced the appointment of Gord Mills, M.P.P., Durham East, to be parliamentary assistant to Solicitor General and Correctional Services Minister David Christopherson. The announcement was part of a reassignment of 13 government caucus members to different responsibilities following the changes to the cabinet announced February 3. Mr. Mills has been parliamentary assistant to the Minister of Municipal Affairs for the past 13 months where he had played a major role in carrying the ministry's bills through the legislative process. He was first appointed a parliamentary assistant in 1990 when the government was formed after the last election. "I am looking forward to working with David Christopherson," said Mr. Mills. "My many years in policing and in the military give me a background that will be helpful in relating to the issues and people at the Ministry."
