The Township owns the Mdrina on the Port Perry waterfront and leases it 10 operator John Mackey. e¢ Township believes that realty taxes should be payable each year. Mr. Mackey dis-agreed agdhe issue first went to court in 1989 with a judge finding in favour of the operator. The Township appealed that decision and the matter was heard June 27 in froft of an Ontario Court of Appeal, which denied the Township's claim because of the word- ing in the lease. Realty taxes for the five years 1987-91 amount to $22,062, with an additional $6,097 in penalties. Township administrator Earl Cuddie said last week he doesn't anticipate any further court action in this issué. But he is concerned that Durham Region and the School bdards may demand their share of the taxes (just over $16,000) and if so, the Township will have to come up with the money. "We are hoping the Region and School Board will accept the (court) ruling," he said. #As operator of the marina, Mr. Mackey has a ten-year lease which runs out in 1995, with an option to renew Tor ten years.
