N BANK'S ARGUMENT PRESENTED IN CASE Procsedings in. in Dominion Steel Dispute Continue © at Halifax HAS NEW ASPECT Develops Into Action Between Trust Company and Banks Halifax, Nov. 16.--Prochedings of the case of the National Trust Company, the Bank of Montreal, and the Canadian Bank of Com- merce, and the Dominion Steel Corporation and the Dominion Iron & Steel Company. regarding the priority claims to funds accumulat- ed from the sale of steel company's products, which is now being heard before Mr. Justice Mellish of the Supreme Court of Nova Scotia, tended to indicate on Saturday that it was developing into an action be- tween the National Trust Company, cn the one side, and the banks, that lay claim to the funds, on the other. W. N. Tilley, K.C., Toronto, re- presenting the National Trust Com- pany, was presenting argument for the greater part of Saturday morn- ing and the court continued through the afternoon until 4.30 while Wial- lace Nisbett, K.C., Toronto present- ed argument on behalf of the banks. The court adjourned until Monday when Hector MacInnes, K.C., Hali- fax, will continue on behalf of the hanks, to followed by C. J. Bur. chell, K.C., Halifax, and Mr. Mar- key, of Montreal ,on behalf of the plaintiffs, the Dominion Iron & Steel Company and the Dominion Steel Corporation. The position of the Dominion Steel Corporation as put forth by Mr. Nisbett was that the corpora- tion had guaranteed to the banks the loan of money to the Dominion Iron & Steel Corporation and the banks claim that the securities are valid and money now deposited there should be applied to payment of indebtedness and thus. release the Dominion Iron & Steel Company from its obligation in that respect. Mr. Nisbett pointed out that the money had been lent by the banks as working capital for the Domin- ion Iron & Steel Company over a receivership of the company. The money had been deposited with the steel industry by the banks to pur- chase material and pay wages, otherwise the plant would have nad fo close down. COWIE LOSES SUIT AGAINST TELEGRAM Newspaper Gets Decision in Hearing in the Milton Court Milton, Nov. 15.--A. A. Cowie, real estate and insurance broker, of Oakville lost his suit for $25,000 alleged libel against The Evening Telegram today when an Assize Court jury decided in favor of the defendant. The suit arose from statements published in The Telegram following Cowie's arrest on charges involving real estate deals, The cases, Cowie emphasized in court today, were later dropped by the Crown, D. O. Cameron, counsel for Cowie, insisted that the published state- ments were false and misleadnig. The report of Cowie's arrest, he said, he was fleeing there was what would suggest that from justice, and purnorted to be a report of court proceedings before any such pro- ceedings took place. D. L. McCarthy, K.C., for the de- fendant, claimed that the newspaper published its report in good faith and that when complaints were re- ceived apologies were printed. Chief Justice Meredith, in his charge to the jury, stated that ac- tions for libel and slander were pe- culiarly within the power of the jury. "The article does defame the plaintiff seriously," his Lordship stated, 'Defendants say the law allowed them to publish that article and that the law absolutely protects them from any actions for damages. A newspaper is privileged to give a fair and accurate account without comment of nroceedings publicly heard before a court of justice, if published contemporaneously with said proceedings." Seizo Okura, azed 24, an instrue- tor at the Ito aviation training school at Tsudanuma, Japan, has announced that he will attempt to establish record time between Asia to Europe in a trans-European flight by way of Mongolia.
