Hellmuth Reads Judg: ments Rendered in Lower Courts ACTS ULTRA VIRES wel arma ts Re verse Three Decisions Al. ready Given mp London, Feb. 29.--In the Tiny Township separate school trustees' appeal to the Privy Council against the decision of the supreme court of Canada dismissing the trustees' appeal from the judgment: of the yegerve [lower court which, if allowed, poser | woula have had the effect of per. mitting the setting up of separate high schools and collegiate insti- tutes in Ontario, under Roman Oatholie Boards of trustees, the ar- gument before the judicial com- mittee of the Privy Council was resumed by I. F. Hellmuth, K.C., Toronto, counsel for the appae lants. Mr. Hellmuth began his argument early last week. It was adjourned op Friday until Monday, Mr. Hellmuth probably will take the whole day in reading the judg- ments given in the case in the low- er courts. Acts Ultra Vires The case first came before Mr, Justice Rose, of the High Court Division of the Ontario Supreme Court in the form of a petition as follows: 1.--For a declaration that eer- tain sections of the education acts of Ontario were prejudicial to the rights of denominational schools and were ultra vires. 2.--To establish that separate schools had the right to conduct grades of education similar to high schools and collegiate institutes. 8.--A declaration that Roman Catholic school supporters were ex- empt from rates for the mainten- ance of continuation schools aot conducted by separate school trus- tees. 4--A judgment against the Province of Ontario for money which the Tiny Township separate s2hool trustees claimed in the dif- ference between the amount awarded out of the grant made by the Legislature for the year | 1922 and the amount which would have come to them if effect had been given to a statute which was in force at the time of confedera- =~ { tion. Mr. Justice Rose dismissed the petition. Thereupon the appels lants took it to the appellate divi- sion of the Ontario Supreme Court, [recs confirmed Mr. Justice Rose's Judgment, as did the supreme court of Canada later when the ap- peal was carried tr that tribupal. From this last decision, the trus- tees appealed to the privy co:1mell.
