COURT OF APPEAL ~~ HEARS ODD CASE Superior Court Overrules Appeal Authority in Crim- inal 'Sentence Quebec, - May 31.--Whether a judge of the Superior Court, even though he be the Chief Justice, has the right to break a decision by the Court of Appeal, or whether this right lies solely within the powers of the Supreme .Court of Canada is a questjon that the Court of Appeal division of three judges, which is sitting in Quebec, is being called on to answer in the case of Walter Boucher, whose case is being appealed by the Crown. . Boucher was originally found guilty of a serious offence, and was sentenced to three months in jail by the Court of Sessions. The Crown immediately appealed the verdict, and the Court of Appeal increased the sentence "to 15 months. Boucher in the meantime had completed his three months in jail, and had been released, but was Te-arrested, on instructions from the Crown. FIRE VICTIM DRUNK IS CROWN'S CHARGE Woodstock, May 30.--A new angle to the fire at Otterville in which James Lefler lost his life last Satubday was brought to light today when Crown Attorney Ball made the assertion in Oxford County Police Court that Lefler was intoxicated at the time of :the fire. This angle of the case devel oped when Carl Hilliker appeared before Magistrate Patterson charg- ed with the sale of liquor. Hilliker pleaded guilty to sell- ing cider to two men last Friday, and Crown Attorney Ball, who prosecuted the case, stated that there was a possibility that Hilli- ker would face a serious charge. Hilliker, he said, had sold the cider to two men, one of whom was burned to death last Saturday, add- ing that in a case of that kind the man responsible for selling the Ii- quor might be held responsible for the death of the victim. EVAGUATION OF © PEINIS LIKELY Japanese Genes Orden the Pekin, May 31.--Because of a reverse to the Northern arms, whose centre at Hokienfu was pierced by Feng Yuhsiang's troops, reports became current that Mar- shal Chang Tso-lin, Northern dic- tator, had decided to evacuate the Capital and retire into Manchuria. While the Southerners (Nation- alists) are certainly pressing the North hard, it appears that there will be no immediate evacuation of Pekin. Chang Tso-lin today called a conference of his Generals and advisers, After full delibera- tion of the military situation, ft was decided not to evacuate the Capital at the present juncture, but to continue to defend the shortened line from Liuliho to Ma- chang. Tomorrow Chang will meet the diplomatic corps, with a view to assuring it that he will continue to be responsible for the protec- tion of the lives and property of foreigners in Pekin, The Northern reverse at Hokien- fu, 100. miles directly south of Pe- kin, is attributed to the defection of the Eighth Corps, which made it necessary for the other troops to fall back .and straighten out their front line. Disorganized Tokio, "May 31.--A despatch from Tientsin says that, because of the fall of Paotingfu, the Northern forces on the Pekin-Hankow Rails way front are retreating. Those on the Tientsin-Pukow Railway, it is declared, are disor- ganized, and have lost their fight- ing spirit. Many are deserting. WINNIPEG MANTIS VICTIM OF SWINDLE Gave $4,000 to Alleged Con. fidence Men for German "Dy e" Winnipeg, May 31.--A. Werrier, Winnipeg, was swindled out of $4,000 in cash by three alleged con- fidence men who "talked" him 'into investing this amount of his hard earned money into an expensive dye, imported from Germany.
