Wallace, AM.C.T., Clerk 405 Dundas Street West, Whitby, Ontario THE CORPORATION of the TOWN of WHITBY BY-LAW No. 61-74 BEING A BY-LAW TO AMEND BY-LAW NUMBER 1784 WHEREAS the Municipal Council of the Corporation of the Town of Whitby deems it advisable to amend By-law No. 1784. NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED as a By-law of the Corporation of the Town of Whitby by the Council thereof as follows: 1. THAT Section 2 of By-law No. 1784 is amen- ded by adding the following subsection: (zzb) "RIDING STABLES' means lands or building used for the purpose of keep- ing, training and exercising of saddle horses including the use of such estab- lishment as a commercial or private club for the riding of saddle horses, but shall not include anything In the nature of a commercial racetrack, nor the keeping, exercising or training of race horses. 2. THAT Section 11 subsection (a) (iv) is amended by deleting the word "'race- tracts" and by adding thereto the words" "riding stables" so that the said subsection as amended, shall read as follows: (iv) Recreational ; Bathing beaches (public and private), golf courses, riding stables and swim- ming pools. 3. THAT Section 11A subsection (a) is amended by adding thereto paragraph (iii) as follows: (iii) (a) Horse racetracks providing that the lot area is at least 10 acres. (b) The provisions of Section 4 (d) of By-law No. 1784 shall not apply to sect- ion 3 of this By-law. 4. This By-law shall come into force on the date it is passed by the Council of the Town of Whtiby, subject to approval of the Ontario Municipal Board. Newman EXPLANATORY NOTE Explanation of the Purpose and Effect of By-law No. 61-74 The purpose and effect of By-law No. 61-74 is to change By-law No. 1784 to make further clarification of the meaning, and to regulate the use of 'racetracks' in a zone designated Agricultural (A). This is achieved by amending Section 11 (a) (iv) by deleting the word "racetracks", and by adding thereto the words "riding stables", and further by adding to Section 2, a new Subsection being Subsection (zzb) "Riding Stables' and by amending Section 11 (A) subsection (a) by adding thereto Paragraph (iii) dealing with Horse Racetracks. The need was discovered by students of Waterloo's School of Optometry who have been working in the Caribbean for the past three summers [iting used eyve- glasses for West Indian children. Just recently a Canadian living on one of the smaller islands purchased four hearing aids for deaf children and found they could hear. He is now teach- ing them to talk. Council decided Monday night, The project was originally meant for senior citizens from Port Perry but the formation of the region and the amalgamation of Reach, Scugog Island, Cartwright and Port Perry into one Township of Scugog had changed the situation. In deciding to allow senior citizens from all over the municipalities councillors , also expressed their desire that only senior citizens who really needed the housing would be allowed residency in the units scheduled for opening this fall.
