If financial trouble strikes, remember col- lectors are more likely to be reasonable when treated openly and honestly - "These agencies are hired by companies to collect overdue debts from customers,' says Bill Stoddart of the On-, tario Ministry of Con- sumer and Commercial Relations (MCCR). "*All professional collectors should realize harassing consumers is not only il- legal, it's not going to get them anywhere. But con- sumers should be aware that hiding from the col- lectors will only make matters worse." Refusal to pay can result in court action, leading to seizure of assets or assignment (garnishee) of wages. Agencies are required by law to notify debtors in writing that an over- due account has been turned over to them. If you receive such a notice, but can't pay off the debt right away, write to the agency, ex- plaining your situation and suggest a way to set- tle the account. Perhaps you can pay the bill in full next month or in regular in- stalments. Whenever possible, include at least a partial payment to show good faith. Never send cash in the mail. "Once you've agreed on a payment plan, stick to it," Stoddart advises. "Bouncing cheques or missing payments will only aggravate the situa- tion. If, for some reason, you can't meet the plann- ed payments, write to the agency again to explain your changed cir- cumstances. Com- munication is the key." Consumers should also know their legal rights when dealing with collec- tion agencies. Debt collectors operating in Ontario are required to register with MCCR and follow a uniform code of ethics Regulations passed in 1983 prohibit collectors from: Starting legal action on the collection of a debt without first notifying the debtor and obtaining the creditor's written permission Making telephone or personal calls of such a nature or frequency to constitute harassment of the debtor or debtor's family Calling to collect a debt on Sunday. statutory hohday, or any day before 7a m or after 9pm Giving out false or misleading information either directly or by implication that could damage the debtor or debtor's family Demanding payment of a debt without ident fying the name of the creditor, the collector and the balance of the money owed -- Continuing to demand payment of a debt from a person who claims not be the debtor, without taking all reasonable steps to confirm the per- son's identity. If you feel a collector has breached any of these regulations, notify the agency of your com- plaint and contact the nearest consumer ser- vices bureau of MCCR. Information on outstanding bills and the involvement of collection agencies usually appears on the debtor's credit record.
