Home warranty protects buyers Anyone planning to buy a home in 1986 should be aware that all new houses in Ontario are covered by warranties. The Ontario New Home Warran- ty Program (NHWP) was establish- ed in 1977 to help promote high quality in the province's housing - stock. In general terms, it ensures buyers of new homes are protected against financial loss to a maximum of $20,000 due to major structural flaws or defects in workmanship or materials. The same amount of pro- tection is provided for purchasers' desposits in the event the builder cannot complete the sale. "For example, if a builder goes bankrupt after you've put down a "deposit on a house, but before con- struction has started, you'd be covered by the program," says Lewis. All builders have to be registered and each house scheduled for con- struction must be enrolled with the program. Once a new home is finished, the builder gives the buyer a certificate of completion and possession. It should not be signed by the pur- chaser until a thorough inspection of the property has been done. The builder will usually accompany buyers on the inspection. Any incomplete work or defects should be noted on the certificate. About six weeks after signing, NHWP will send you a warranty certificate. It's important to note that the pro- gram does not cover incomplete work. If your new house is not ready for occupancy on time or if any work is incomplete, discuss the situation with your lawyer. 'But keep in mind, we're talking about actual defects -- construction that doesn't meet building code standards or flaws in workmanship and materials." During the first year, any defects should be reported in writing to the builder. Include your warranty number, the lot and plan numbers and an explanation of the problem. If the company does not respond within fourteen days, advise NHWP of the situation and conciliation will be arranged. Homeowners with legitimate com- plaints are guaranteed action on their problems, Lewis; says. The builder is required by law ta fix everything covered by the warran- ty. If the company defaults, NHWP officials will arrange for repairs and deal with the recalcitrant builder themselves. Remember, unresolved problems must be reported to the warranty program office in writing before the end of the first year. During the next four years, houses are covered for major structural defects only. "The extended coverage applies to serious problems such as founda- tion defects that threaten the struc- tural integrity of the building and problems with load-bearing walls or roof joists,' says Lewis. Major structural defects that become apparent between the se- cond and fifth year should be reported in writing directly to NHWP before the end of the fifth year of possession. Send copies of any such letters to the builder.
