Provincial legislation presently prohibits certain stores from stay- ing open on Sundays and other . statutory holidays during the year. However, the Durham Region council has the authority to exempt stores in designated "tourist areas" from the law which would permit them to stay open on Sundays. While it is the Durham council that ultimately decides on declaring an area as tourist, Mr. Hvidsten told the meeting that support from the local municipality (Scugog) is crucial. The local Chamber of Commerce initiated the move to declare Port Perry a tourist area about three weeks ago when there was a com- plaint lodged with the Durham Police about two Queen Street stores that are open for business on Sundays. Mr. Hvidsten said the directors of the Chamber of Commerce voted -unanimousiy to ask that Port Perry be a tourist area. He went on to say that not all members of the Chamber support the move, but the majority have no opposition, even if they have no plans to open for business on Sun- '""We are not suggesting or even asking that all businesses stay open, only that they be given the opportunity if they so desire," he told the meeting. Members of council listened to the presentation, but decided they wanted a week before making a decision on whether to support the Chamber in this move. At this time, there is no "designated tourist area' within the Region of Durham. Efforts in the past to have south Oshawa and Newcastle designated met with failure. However, there are several municipalities in Ontario that have the designation such as Niagara- on-the-Lake. The whole issue of stores being open on Sundays and statutory holidays is presently in front of the Supreme Court. One Toronto mer- chant has been charged over 100 times with keeping his retail store open on Sundays.
