26 -- PORT PERRY STAR -- Tuesday, January 23, 1990 Council wrestles with crossing guard issue Scugog Township is still searching for a crossing rd for the intersection of Highway TA and Lilla Street in Port Perry. The Council has received many letters of concern from parents whose children have to cross this busy intersection with no help. The Township has had an ad- vertisement in the Port Perry Star, but has had no response to the position. Councillor Marilyn Pearce stated the situation is one that needs a quick solution, and does not feel they will find any- one to take over the position. The i» pays seven dollars an hour, but Councillor Christie does not feel that pay is the problem. She states she feels people are afraid of lawsuits, of parentssuing. Council stated they used to have a network of seniors who were more than willing to do the job, now nooneis offering. uncillor Pearce stated she wants to contact the School Board, and let them know that not due to lack of effort, there is a dangerous intersection, that they cannot find a crossing guard for. Most of the children who have to cross this intersection are from Apple Valley, and at- tend R. Cornish Public School. A count of children crossing this intersection has not been taken, but according to Councillor Pearce, there are 250 homes in Apple Valleyand many children from these homes are now crossing with- out the aid of an adult. Councillor Pearce states she feels one solution would be for the School Board to re-align their boundaries. She stated that she feels that a solution would be for all stu- dents in Apple Valley to attend S.A. Cawker Public School, in which a bus would pick them up and the problem of crossing this intersection would be eliminat- ed. According to Administrator Earl Cuddie, for a bus to pick up the children in Apple Valley to take to R.H. Cornish is out of the question in the Board's mind. Councillor Pearce also stated that Mr. Todd the principal of R.H. Cornish is also very con- cerned about the situation, and has sent representatives to check the intersection at differ- ent times, and neither time has a crossing guard been there. She went on to say that Mr. Todd as well is going to contact the Board about this situation. Mayor Howard Hall stated that he would contact a School Trustee, to discuss the situa- tion, and hopefully find a much needed solution to the problem. Shanly office appeal filed The on-going legal battle over an office building on Shan- ly Street took yet another turn last week with the lodging of an appeal of a December 20 court decision which ordered the building removed. The appeal by the law firm of Fletcher-Tesluk, owners of the building, was filed January 17 by a Toronto law company, Du Vernet Stewart. In the notice of appeal, the appellants Fletcher-Tesluk claim ten errors in the Decem- ber 20 judgement of Madame Justice Boland of the Supreme Court. The white, single storey building has been sitting on Shanly Street- just west of Wa- ter St. for nearly four years, since it was moved by Fletcher- Tesluk from its former location on Queen Street. Scugog Township started legal action to have the building removed,claiming that portion of Shanly Street where it now sits is not an open municipal " road. Among other reasons, the notice of appeal states the judge erred in failing to find that Shanly St. was an assumed and open street for public use, and that itis not an improved public street maintained year round.
