Wood carving, he says, helps to keep him young. He also donated a similar plece of art to the museum in Uxbridge Township. "The Board does not believe that the term 'bona fide farmer' must mean a person who works full time on a farm and is suc- cessful in the operation so that no additional income from out- side sources are needed for a reasonable living," the judge- ment states. The OMB ruled on the ap- plication for a retirement lot by Mr. and Mrs. Arie Kuiper, who have owned 86 acres on Conces- sion 2, Scugog, since 1974. The Region, Scugog coun- cil, and the Ministry of Agricul- ture were opposed to the sever- ance. In ruling in favour of Mr. and Mrs. Kuiper, the Board ac- knowledged that Mr. Kuiper had other business interests off the farm. But the Board agreed with the argument by Mr. Kuiper that his wife had been ignored in the application for the sever- ance. She is owner of the farm with her husband and worked it for 16 years without seeking other employment or income ex- cept that from the operation of the farm, said the judgement. The OMB judgement said that iflocal and Regional zoning restrictions are designed to al- low farm retirement severances only for those who have worked most of their lives full time on the farm, then this should be | PLEASE RECYCLE spelled out clearly in the regula- tions. Durham Region has been working on changes to the Offi- cial Plan which relate to rural severances for the last couple of years. The intent is to make it more difficult to obtain sever- ances in rural areas. However, the changes have yet to be adopted by Regional council. The Kuipers first applied for this severance in 1987 and were turned down by the Re- gion's Land Division Commit- tee. They made a new applica- tion a year later with the inten- tion of retaining the retirement lot and selling the remainder of their holdings. In granting the retirement lot, the OMB stipulated that no further lots can be severed from the farm, and this must be reg- istered on title.
