BARGLAY ESCAPES DEATH SENTENCE {Credit Given Spiritual Ad- viser for Last Hour Cab- inet Action Toronto, July 31.--The hang- man's noose will not be slipped over the head of William Barclay at the Don jail.on Thursday morn- ing. His death sentence, the pen- alty for the murder of Mrs. Agnes Hudson, his common law wife, last New Year's eve, was commuted unexpectedly last night by execu- tive decree, He will spend the rest of his life in Portsmouth peniten; tiary. The reprieve came from Ottawa last night. At noon, the cabinet at Ottawa ,sat to consider his plea | for commutation of sentence. At 2 o'clock the cabinet had decided in favor of a reprieve. At 2.30, a { messenger was hurrying from the capital to Dorval, Quebec, near Lachine, "bearing the order for clemency. At 6 o'clock, Mr, Jus- tice Migneault, at his summer home at Dorval, had received the messenger, had read the plea and had affixed the royal assent in his capacity of acting governor-gen- eral. On receipt of official word of the reprieve, Major G. H. Basher, governor of the jail, and Rev. T. W. Barnett, the condemned man's spiritual adviser, set out for Bar- clay's cell. They motioned the death-watch away and walked in. Very Much Surprised "Bill, your sentence has been commuted. You aren't going to hang," Rev. Mr. Barnett burst out as the two men entered the close little death cell. "What?" returned Barclay. "What do you mean?" He looked up from his cot, a curious expres- sion on his face, as the padre threw an arm about him. "The government has decided not to let you be executed. You are to go to Kingston instead. Oh, Bill. I'm so glad," and the clergy- man, greatly affected, sat down beside the saved man. "William Barclay, ment has commuted your death sentence. You will, instead, be imprisoned for life," the jail gov- ernor formally added and then, his official duty carried out, he too joined in happily congratulat- ing the bewildered, but happy Barclay. Out of the little death cell on the south side of Don jail, Barclay was taken and placed in another corridor. His death watch was re- moved and preparations for his removal from the jail to peniten- tiary went ahead. + Waited for Official Word The governor and the clergyman waited for some time after the decision had been made at Ottawa, before telling Barclay, It was 10.30 .o'clock when the visit was made to Barclay's cell. "I hope it's true. This is the first really happy moment [I've had since Barclay was convicted of murder and sentenced to hang last May," Mr. Barnett cried as the news was first broken. "I had never quite given up hope, al- though events in the past few weeks have left slight room for chances of a reprieve." After waiting an hour for of- ficial word of the reprieve and hearing nothing, Mr. Barnett walk- ed with joyful step to Barclay's cell and, without telling the con- demned man anything of the news, visited with him for 'some time, reading scripture and praying. At 10.30, a telegraph boy reach- ed the home of Dr. R. A, Pyne, sheriff of the city of Toronto. The sheriff, who had previously been told of the reprieve unofficially, read a message from Ottawa: "Death sentence of William Barclay commuted to life impris- onment." Immediately Dr. Pyne the govern- phoned 'office, Mr. Barnett Don jail. Governor Major Basher answered and heard the official word that saved Barclays life. Across the desk in the governor's waited. His face was wreathed in smiles as Major Basher nodded to him the official news, Today Sheriff Dr. Pyne will for- mally sign an order for the dis- patch of Barclay to Kingston peni- tentiary and the case, as far as local courts are concerned, will be closed. R. Dixon of Sprucedale was chosen as the Liberal candidate to represent this constituency in the coming provin- cial election. Several others were nominated, but all withdrew in favor of Mr. Dixon who was given a rousing re- ception, and made an eloquent ad- dress following the close of the nominations. W. E. N. Sinclair, Liberal leader, addressed the meeting. He stated that he thought there would be an | election this fall, and gave several reasons for this belief: the brew- ery cheques were being collected for this fall; the Toronto organiza- tions had received word to be in readiness; Mr. Ferguson has not denied that there will pe an elec- tion; Peter McGibbon, M.P. ror Muskoka, announced that there would be one, and Mr. Ferguson stated that he would have an ele:- tion when the going was good for the Conservative Party. The speaker discussed the Old Age Pensons Act, the gas tax, the long-delayed road report just issu- ed which was three years old, and other vital questions. Mr. Fergu- son had been forced by Liberals to accept the old-age pensions scheme of the Dominion Govern- ment, he said, but had assessed the municipalities. Also, he said, the Ontario Government was to take over the property of the pensione: and at his death his widow should she be under 70 years of age would be penniless. The gas tax brought in millions of dollars, which for the most part, went to Queen's Park for ordinary revenue, he said, but was not spent | on roads. "I would not be leader of a gov- ernment that could not give a bet- ter business administration than Ferguson Government has given this Province," stated the speaker, "and that Government was elected on a platfom of economy. "Following Mr. Ferguson's trip to Europe to discover better meth- ods of education, Mr, Finlayson had taken the same trip, and had discovered that the best way to grow trees was from the seed. "What other way would you grow trees?" asked the speaker, amid laughter. "Mr. Ferguson has stated that he will change the names of highways to the King's Highway, though he has not as yet announced any change in the name of the Ferguson Highway; prob- ably he intends to share the honors with the King."
