Further, Great Britain recognizes that the protection of foreigners in Egypt is a matter devolving solely upon the Egyptian govern- ment, . The protection of minorities was one of the four "reserved" points by the British government two vears ago, but it is mow admitted htat this will be exclusively the concern of the Egyptian govern- ment. The variations from the treaty of 1927 will give Egypt a greater measure of real independence than ever before proposcd. Some poin's not mentioned in the draft pro- posals are made clear in accom- panying explanatory notes. Thus, the British inspector-gen- eral of the Egyptian army will cease to function completely and all British personnel will be wich- drawn from the Egyptian forces. Similar concessions 'n oth:r re- spects are foreshadowed in the notes exchanged. For instance, Egypt retains the right to engage Egyptian officials in various ad- visory capacities where British of- ficilals hitherto were employed. The most important concession on Great Britain's part is the with- drawal of British garrisons to the canal zone. This Was refused in the negotiations with Sarvat Pasha two years ago. Sir Austen Cham- bgrlain, then secretary of state for foreign affairs, held out this as a possibility ten years hence. Parliament Must Approve Mr. Henderson, in a note to Prime Minister Mahmoud, stipu- lates that these new proposals must first be approved by the newly-elected Egyptian parliament before they can be submitted to the British parliament for ap- proval and embodied in the treaty. This is considered a most im- portant point. Ever since Egypt re- jected the draft treaty of auutmn, 1927, the constitution of Egypt has been suspended and the gov- ernment carried on by a pro- British premier who in Egypt is regarded as ga dictator in the inter- ests of Great Britain. Hence, it is considered a moot point whether the followers of the Zaghoul party, who form a great majority of the Egyptian electorate and who were responsible for the rejection of the 1927 treaty by the Egyptian parliament, will be will- ing to endorse a treaty negotiated by a dictator, despite the great concessions it makes to Egyptian demands. Mr. Henderson, evidently fore- seeing possible difficulty on this point, in a note to Premier Mah- moud, says: "It is the earnest hope of His Majesty's government that patriotic Egyptians, witHout distinction of party, will examine these proposals in the same friend- ly and conciliatory spirit which has characterized our recent con- versations." Settlement Proposals Following are the proposals for an Anglo-Egyptian settlement: "The military occupation of Egypt by forces of His Britannic Majesty is terminaetd. "An alliance is established be- tween the high contracting parties in consecration of their friendship, their cordial ' understanding and their good relations. "Egypt being anxious to be- come a member of the League of Nations, will present in waccord- ance with conditions prescribed by article 1 of the covenant, a request for admission to the league, which His Britannic Majesty undertakes to support. "Should any dispute with a third state produce a situation which involves the risk of rupture with that state, the high contract- ing parties will concert together with a view to the settlement of the said dispute by peaceful means in accordance with the provisions of the League of Nations and of any other international obligations which may be applicable to the case. : "Each of the high contracting parties undertakes not to adopt in foreign countries an attitude which is - inconsistent with the alliance or which will create difficulties for the other party thereto. "In pursuance 'of this under- taking they will not oppose each other's policy in foreign countries nor conclude with a third power any agreement of a political char- acter which might be prejudicial to the interests of the other party. "His Britannic Majesty recog- nizes that responsibility for lives and property of foreigners in Egypt devolves henceforth upon the Egyptian government, The King of Egypt will insure fulfilment of his obligations in this respect. "Should, nowithstanding the provisions of paragraph 4, either high contracting party become en- gaged in war, the other high con- tracting party will be subject al- ways to the provisions of para- graph 14, and immediately come to his aid in the capacity of aun ally, Particularly Hig Majesty the King of Egypt will in the event of war or the menace of war, fur- nish his Britannic Majesty on Egyptian territory all facilities and assistance within his power includ- ing the use of airdromes and means of communication, "In view of the desirability of identity in training and methods between the Egyptian and British armies, the King of Egypt under- takes that should he deem it neces- sary to have recourse to foreign military instructors, these shall be chosen from British subjects. Canal Zone Retained "In order to facilitate and to secure to his Britannic Majesty pro- tection of the Suez canal as an essential means of communiation between different parts of the British empire, the King of Egypt authorizes his Britannic Majesty to maintain on Egyptian territory in localities to be agreed upon to the east of longitude 32 degrees east, such forces as His Britannic Maj- esty deemg necessary. "The presence of these troops shall not constitute in any manner an occupation, and will in no way prejudice the sovereign rights of Egypt. "In view of the friendship be- tween the two countries and the alliance contemplated, the Egypt- jan government when engaging the services of foreign officials, will, as a rule, engage British subjects. "His Britannic Majesty recog- nizes that the capitulatory regime now existing in Egypt is no longer in accordance with the spirit of the times and the present state of Egypt: Accordingly, His Birtannie Majesty undertakes to use all his influence with the powers possess ing capitulatory rights in Egypt to obtain conditions which will safe- guard the legitimate interests of foreigners, transfer to the mixed tribunals the jurisdiction of exist- ing consular courts and to obtain the application of Egyptian legis- lation to foreigners, Will Exchange Envoys "In view of the friendship be- tween the high contracting parties and the alliance contemplated in the present proposals. His Britan- nic Majesty will be represented at the court of the king of Egypt by an ambassador duly agcredited, and the king of Egypt will reserve the highest diplomatic rank at his court to the representative of His Britannic Majesty. The king of Egypt will be represented at the court of St, James by an ambassa- dor. "While reserving liberty to con- clude new conventions in the fut- ure modifying the conventions of 1899, the high contracting parties agree that the status of the Sudan shall be that resulting frcs the said conventions. Accordingly the governor-general shall continue te exercise on the joint behalf of the high contracfing parties the powers conferred upon him by the said conventions, "Nothing in the. present pro- posals intended or shall in any way prejudice the rights and obliga- tions which devolve or may de- volve upon either of the high con- tracting parties under the coven- ant of the League of Nations or the treaty for the renunciation of war, signed in Paris 1928. "The high contracting parties agree that any difference on the subject of application or inter- pretation "of provisions of the present proposals which they are unable to settle by direct negotia- tions shall be dealt with in accord ance with provisions of the coven- ant of the League of Nations. "At any time after the expira~ tion of a period of 25 years from the coming into force of a treaty based on the above proposals, such modification of its terms as may be deemed appropriate in the cir- cumstances as they then exist, may then be made by agreement be- tween the high .contracting par- es." ; August 27, WYSTERY GUND FATALTO BOY Experts Testify Doctors Helpless in Case of Fenn Toronto, Aug. 7.--Victim of a mysterious internal condition pe- culiar to children, a malady which has baffled medical science since the 17th century, seven-year-old Robert Douglas Fenn died while under an anaesthetic, despite the care of qualified doctors who were removing his adenoids and tonsils. Expert testimony at the inquest in- to his death last night showed that the anaesthetic had been adminis- tered in the regular way, but that the boy was suffering from an un- detectable ailment which might cause sudden death to follow the slightest shock. Criticism of Toronto school doc- tors pestering parents into having unnecessary operations performed on their children, was voiced by Harry Fenn, the boy's father. Asking the coroner if he might say a few words, Mr. Fenn came to the witness box and told the jury that if the operation had not been performed his boy would still be alive and well. "Our family doctor did not think he needed to have his tonsils out immediately," complained the ber- eaved father, but the school doc- tor and the school nurse had both- ered the parents so that they were practically forced to arrange for the operation. "I think you gentle- men might bring in some recom- mendation about this practice," Mr. Fenn told the jurors. Everything Possible Done Theé verdict handed to Dr. W. H. Burgess, the presiding coroner, stated that the jury found "that Douglas Fenn came to his death ort July 20, 1929, from a condition known as status lymphaticus, walle under an anaesthetic in the Coron- ado hospital, Toronto, and everything possible was done by the _ attending physicians to save hik life." Dr. R. C. Coatsworth, the anaes- | thetist, said that he had adminis- tered more than 1,000 anaesthetics, and outlined to E. J. Murphy, re- presenting the crown, how he had given a small dose of ethyl chlor- . ide--"the minimum possible' -- and then switched to ether. He had examined the patient's heart thor- oughly only ten minutes before, he stated and found it in perfect con- dition. "Then what is your explanation of this?" asked the crown. "I can't say," he ahswered. No ether had been given after the first tonsil was removed, testi- fied Dr. R. D. Fisher, who was per- forming the opération. He had cut out both tonsils, cleaned the throat, and removed the adenoids and was expecting the patient to show the first signs of returning conscious- ness when the boy suddenly turned blue. He saw. Dr. Coatsworth throw down his apparatus and start. artificial respiration.
