Suddenly, he noticed a car ap- proaching , in "the opposite direc- ton and in the fog he said it look- ed like * a streak of wind." He feared that the approaching car would hit ihe Johuston machine but instead it collided with the left front wheel of his own sedan. The sedan swerved towards the east ditch of the rcad while thé other car, a coupe, continued north, finally landing in the east ditch with its front pointing north- west. He told the jury that he could have done nothing to -avoid the crash, as the approaching car was crowding over to the wrong side of the road. ' Dr. R. T. MacLaren who had been called to the scene of the crash shortly after the accident occurred stated that he had Rodd removed to the Oshawa Hospital in an ambulance. The young man never gained congciousness and died last Thursday morning, Rodd was suffering from injuries to the brain, a fractured jaw and frac- tured collar bone, Dr. Maclaren stated. Death had been due to in- juries to the brain, On Wrong Side of Road The Rodd car on the wrong of the road when the crash occurred, accord- ing to the testimony of Georg: Johnston, lumberman of Blackwa ter who was motoring on the high- way. Mrs, Johnston was driving while other occupants were Miss Ida Moore, of Manilla, and a Buff- alo man. They were driving a short distance in front of the Free car and while a mile north of Brooklin saw a car approaching. "It seemed to be coming on an angle towards us," witness stated, 'so 1 warned my wife to get over to the side of the 10ad as far as possible." Frank Harrison, taxi driver of Erooklin, said that he arrived at the scene of the accident a short time after it had occurred. Free's car was in the east ditch while Rodd's coupe was about 100 feet further along the highway with its rear wheels in the ditch, The coupe was so badly damaged that 1 © did not recognize it. Ivan Rodd, postmaster at Myrtle told the jury that he had identi- fied the body of his Lrother, Chief Took Measurements Chief H. Gunson, of Whitby, told of going out to thc scene of the accident in an ambulance, Aft- er helping to assist the injured he had made measurements which showed that the coupe had come to rest 48 feet north of the spot where the accident took place while the sedan had travelled 17 feet south. According to marks on the road he had concluded that Rodd"s machine was three feet over on its wrong side of the road when the crash took place. Constable George Brown of Brooklin confirmed the measure- ments given by the Whitby chief of police. The cars were about seventy fcet apart, he stated. The accident is one of the worst to have occurred on the Whitby- Lindsay highway and the lives of all three occupants of the coupe were snuffed out, Crown Attorney MeGibbon in- terrogated the witnesses. Mem- bers of the jury included Alex McLeese, foreman; Ernest Flint. off, James Thorborne, W. M. Sta- cey, Ernest Blair, Wm, Igel, Jas. Bishop, Harold Irvine and C. Stur- gess.
