Erin Howard will be demoted from First Class Constable to Second Class for three months, resulting in a loss of income, after lawyers for the prosecution and defence made a joint submission on a penalty during a disciplinary hearing Tuesday, Dec. 6. Five other charges, including insubordination, were withdrawn when Howard entered her guilty plea. Howard was charged with offences under the Police Services Act after an internal investigation by the service into a video she posted on social media, expressing her enthusiastic support for the so-called Freedom Convoy that converged on Ottawa in late January. The demonstration, originally described as a protest against measures imposed by the government to stem the spread of COVID-19, eventually became an illegal, weeks-long occupation. It was finally broken up when the federal government invoked the Emergencies Act in mid-February. In the video, Howard spoke into a camera while dressed in her uniform, offering a "shout out" to convoy participants. "I think what you guys are doing is incredible. You're fighting for our rights and freedoms," Howard said in the video. "Right now, it feels we're a little bit at war and those rights and freedoms are at stake." Howard also appeared at another event protesting COVID-19 measures, saying her police colleagues had been "brainwashed" and that her badge was "tarnished." In her comments Howard also divulged details of "confidential" communications with a superior officer, Durham police alleged in a document summarizing allegations. Howard's plea came weeks after the resolution of a disciplinary matter involving her husband, Durham police officer Clay Harnum, who also pleaded guilty to discreditable comment for his actions relating to COVID-19 protests. Harnum was docked 60 hours pay. After Howard was charged Harnum took to social media, posting the police chief's email address and encouraging followers to voice their support for her. Chief Todd Rollauer eventually received more than 500 emails about Howard. That flood of messages prompted Durham police to conduct a "threat assessment," a decision in Harnum's case noted. In May when the Howard was scheduled to appear before the disciplinary tribunal, dozens of people gathered outside Durham police headquarters in Whitby to voice their support for her.
