Kellock .of the Surreme Court of Canada Thursday refused a motion for leave to appeal before the court the case of Sydney Cham- bers, 35-year-old St. Catharines sta- tionary engineer convicted of the murder. of Marion Rusnik. The decision left no hope for Chambers to escape hanging Dec. 16, barring an 1lth-hour clemency ruling by the Justice Department. Chambers, in a confession ac- cepted by the court, said he burned the body of 9-year-old Marion Rus- nik in the cannery where he was employed, The incident took place last Dec. 23, and Chambers was twice convicted of the murder charge, the Ontario Appeal Court upholding the second conviction. Chambers' counsel opened appli- cation today for leave to appeal to the Supreme Court on the ground the Ontario Appeal Court's judg- ment conflicted with decisions ren- dered by other courts on the same level.
