"A Family Tradition for 130 Years" Cited for property standards violation Nestleton man wants apology from township By Jeff Mitchell Port Perry Star A Nestleton man is de- manding a public apology from Scugog Township for what he says amounts to harassment by the bylaws department. Vernon Yorgasen says the township has intruded on his Hwy. 7A property, and is hassling him over vehicles and machinery he 1s either fixing up for him- self, or using for his farm operation. 'But he's not likely to be on the receiving end of a township apology any time soon, said Scugog's administrator, Earl Cud- die. He said the municipal- ity is following up on a complaint, as it's required to dounderits bylaw. The township has is- sued a warning under the property standards bylaw in an attempt to get him to clean up the property, but Mr. Yorgasen feels action was begun against him be- cause the township thought he was fixing cars for money, a commercial operation that's not allow- able on his property's zon- ing. "I haven't taken a nickel for fixing a car since 1961," he said. "I have old cars be- cause I can fix them. It ap- pears they are unhappy with my hobby." He agrees his property needs work -- he said he's hauled dozens of loads of old machinery off the farm he bought 17 years ago -- but insisted anything that's still there is either being moved, fixed up, or is part of his farming oper- ation. And his home's distance from the highway is a fac- tor too, he said. "I'm a quarter of a mile off the road," said Mr. Yor- gasen. "If they're driving and paying attention to what they're doing, they shouldn't even see me." He said hell comply with requests by the town- ship to clean up derelict vehicles and such, but wants the municipality to apologize for allowing a bylaw officer to go onto his property -- Mr. Yorgasen says that occurred with- out his permission -- and take pictures. He also feels the hard line should not have been taken by the township, especially after he explained his situation and agreed to cooperate. He's contacted a lawyer, and says he'll press the is- sue -- in addition to seek- ing reimbursement for costs he incurred to rush back home from Alberta after the notice was given by the township. But Mr. Cuddie says the township has acted in ac- cordance with its bylaw, after a complaint was filed with a township council- lor. He said the municipal- ity is merely addressing the situation, as it is re- quired to do. "(Mr. Yorgasen) hasn't been charged with any- thing," said Mr. Cuddie. "He's just been asked to clean the place up. "I have no intention of apologizing." The administrator add- ed that the township's first priority -- as it is in most property standards cases -- is to come to an agreement with the prop- erty owner, and avoid drawn-out court proceed- ings. "We're really not inter- . ested in a fine," he said. "Where we would like to go is to see the place cleaned up."
