After stories about the suit appeared in the Port Perry Star, several home owners are angry with other Victorian Village residents who say they're pleased with the construc- tion of their houses and with the customer service they received after they moved into their homes. The lawsuit, which hasn't been proven in court, alleges substandard materials, workmanship and-inspection led to a number of problems with the houses. Carole Leveille, who owns a model of home referred to as the "Peter Perry", says she had to replace siding on the front of her home, and the prob- lem is still not solved. "The contractor who re- did the front told us that the flashing (metal designed to carry rain water from one surface to another) was too short, and that the black paper (installed before siding is placed on a wall) was at best, sporadic," she said. "We had the posts on our porch go rotten, the windows leaked, and just one problem after another. We've spent over $10,000 on the house and we are still having problems." Ms. Leveille said she took offense at what she thought were implications by other home owners that the problems sighted in the suit were a matter of poor maintenance on her part. "We have painted this house four times in seven years; you call that lack of up keep?" Dave Kempton lives Just down the street, also in the Peter Perry model, and describes problems similar to the ones faced by Ms. Leveille. Some damage is evident on his home, as he has not yet replaced any of the origi- nal work done by the builders. "We had to entirely abandon our front bed- room because of the cold in it and the water prob- lems," he said. "You just can't keep that room warm." Scugog Regional Councilor Marilyn Pearce feels the matter may have to be settled in court. "I have said since I was first made aware of possi- ble troubles there that we need to find out more about the building code at the time," she said. "Were changes made to the code after the houses were built? Were the homes built to a standard that proved to be inadequate? I don't know." Angie DeJong would like to see some problems addressed as well. She refers to as a "nightmare of problems" with their home. "We had a major leak, I mean a huge leak, in the. bathroom upstairs, and we were told that it was a caulking problem. Well that didn't solve the prob- lem. Then we discovered that the collar on a pipe on the roof was not even in place and there was a huge hole in the roof," she said. "The water just poured in." "We support Dianne Bunn in this suit. She is fighting for all of us." The date for the class action certification, which will determine wether the case can proceed as it is written has not been set yet.
