According to Caterina Gucciardi, a representative for West Shore Retirement Living Corp., figures put forward by contractor Stoneport Construction Ltd. in a lien claim are inaccurate. Stoneport, which withdrew from the project last year, claims more than $600,000 remains unpaid by West Shore. "They're way off... there's no way it's over $600,000; no way. That's not even close," Ms Gucciardi said from her Whitby office last week. "There's something very seriously wrong with the numbers there, given the number of deficiencies with the invoices," said Ms Gucciardi. The adult living community -- locat- ed at 293 Perry St. on the west shore of Lake Scugog -- has been a source of controversy since construction first began several years ago. Residents first opposed building the project on waterfront property, subsequent problems and delays quickly soured the public's opinion of the project. For a time, work ground to a hait, and half-finished buildings loomed on the site. Troubled project Financial problems arose once more last fall when a number of liens were filed against the property at the Land Registry office in Whitby. Included in those liens is one for more than $600,000, filed by Stoneport Construction Ltd. Andrea Habas, lawyer for the Toronto contractor, said last week that under the Construction Liens Act, all parties with claims must come together in the next few weeks to try and work out a resolution. "The litigation goes on," she said. "The next step is settlement talks, Parties in West Shore dispute sti which we are required to do under the Act. "There will be a meeting between all the parties to try and work on a settlement, but that's unlikely," said Ms Habas, adding that a date should be set near the end of January for West Shore and "six or seven" other groups to sit down and talk. "I'd like to see this completed fast, but a settlement is unlikely and we'll probably go through with prosecu- tion," said the lawyer. "At this point it doesn't look like there'll be a settle- ment." West Shore officials would be glad to talk, says Ms Gucciardi. But there remains disagreement over the amount of monies owed, she added. "We would be open to discussions, but quite a bit of financial information needs to be provided by Stoneport. There's a lot of questions to be answered," she said, noting that all the figures were supposed to be for- warded to West Shore before Christmas. They still hadn't been || far apart received by Jan. 4, she said. "We're requesting validated copies of the invoices; there needs to be a full accounting before a settlement is reached. The ball is in their court now; we may have to go to court to compel them to provide the numbers." Liens called incorrect According to Ms Gucciardi, the liens filed against West Shore by a number of companies are incorrect. She claimed that those filing liens held work contracts with Stoneport Construction Ltd., and not West Shore. Ms Gucciardi said Stoneport was responsible for paying subcon- tractors. Cheques were issued to Stoneport Construction for the work, she-said. "The contract was between Stoneport and (subcontractors); the owners had nothing to do with it," she said, adding that West Shore offi- cials stopped issuing cheques when it "became clear the sub-contractors were not being paid."
