Inspector Chuck Mercier, the top officer in 26 Division, gave brief answers last week when asked about the charges three officers -- two from York Region and one from Durham's own 26 Division: -- are facing. "We're not at liberty to discuss an SIU investiga- tion or the results... it is totally in their hands," Insp. Mercier said Thursday morning, a day after the SIU announced that York Region Constable Randy Martin would be charged with one count of second-degree murder in relation to the shooting death of Tony Romagnuolo, a 44-year-old father of three who lived just southwest of Sunderland. The recommendation by "the SIU is the first time the agency has recommend- ed a murder charge in its nine-year history of inves- tigating police actions. The most serious charge laid against an officer prior to last week's announcement was manslaughter. "I'm also not at liberty to discuss any cases that are before the courts presently," said Insp. Mike Hoskin was also charged; he faces one count of assault with a weapon and one count of careless use of a firearm. Const. George has not been charged. Const. The three officers were officially charged Wednesday after the SIU wrapped up a three-month investigation in the Dec. 28 fatal shooting of Tony Romagnuolo. While details are unclear at this point, it is widely speculated that a scuffle ensued between the parties after either Mr. Romagnuolo or one of his sons reached toward an officer and may have appeared to have been lunging for his weapon. As a result of the inci- dent, Mr. Romagnuolo was shot at least three times, according to the SIU. charges The SIU has confirmed that all three officers at the scene fired their weapons. Rocco Romagnuolo, the victim's 17-year-old son, was shot in the abdomen during the dispute, and was hospitalized for an extended period. York Const.
