bo "A Family Tradition for 132 Years" PORT PERRY STAR - Tuesday, June 8, 1999 - 13 Township hopes to avoid full hearing into plan By Chris Hall Port Perry Star Scugog Township's staff and lawyers have begun preliminary work on defending the municipality's new Official Plan before an upcoming hear- ing before the Ontario Municipal Board. A meeting last week of staff and solicitors representing both Scugog Township and Durham Region was just the beginning of what Scugog CAO Earl Cuddie expects to be a long process. "We're at the point now where we're trying to develop a game plan," he said. "We've been directed by council to do what we can to get approval for the Official Plan. This is a matter of impor- tance to us." The basic plan, he says, is to try and show the OMB that the new plan is what is best for the municipality. "When we meet with the Board, whether it be a pre-conference or the actual hearing, our goal is to try and persuade them that our idea is better and that our plan is solid, which I believe it is," he said. It is Mr. Cuddie's hope that a full- blown hearing into the appeals can be avoided altogether. "Maybe we'll be fortunate enough at the pre-conference -- which should be in a couple of months -- that we can convey the message and either the appellants Alzheimer's workshop planned will drop their appeals or that the Board will see our side in the matter," he said. Four Scugog residents have filed appeals against Scugog's OP. Included in that group are Colin Kemp of Nestleton; Scugog Island resident Ray Reader, and Doug Wilson and his daughter Wendy, who own property south of Port Perry. In their 1999 budget, Scugog council- lors set aside between $20,000 and $30,000 for legal items, trials and hear- ings, said Mr. Cuddie. He noted that the cost of this hearing before the OMB "will be substantial". If the OMB does decide to go ahead with the hearing, 35 days of notice will be given before the sides appear before the board. If a hearing is held there is a potential for more appellants to step forward and argue against the docu- ment, Mr. Cuddie said. If the appeals go forward, the hear- ings will likely be held either at the Durham Region headquarters or at the Scugog council chambers. The OMB will decide whether to send one official to make a ruling, or rely on a panel of two or three to hear the mat- ters. The Ontario Municipal Board is a quasi-judicial body which rules on appeals of municipal planning matters.
