"A Family Tradition for 132 Years" Former em By Rik Davie Special to the Star Local naturalist Bill Lishman and his fash- ion designer wife Paula have been charged with theft by a former employee over events that have unfolded in a civil suit involving a local political activist. Well-known Oshawa defense counsel John Olver, attorney for the Lishmans, was in court last Monday in Oshawa to set the matter over until July 6. While he declined any comment on the matter, Mr. Olver did indicate that his clients would be defend- ing the charges vigor- ously. A source close to the case told The Star that the alleged theft involves articles of mail. The source said the mat- ter came to light during evidential discovery for a breach of contract action brought by the Lishmans against Colin Kemp of Nestleton, a former associate of the Lishmans. According to police who investigated the matter, two pieces of mail allegedly directed to the former Lishman employee -- Chris Ewart of Oshawa -- were deliv- ered to the Lishmans, and found their way.into records that were dis- closed during the civil action ~~ Lishmans brought against Mr. Kemp. They could not say how the employee became aware of the misdirection of the mail. Paul Mooy of Port Perry's 26 Division confirmed that he had investigated allegations of theft involving arti- cles of mail brought for- ward by a woman for- merly employed by the Lishmans. "We looked into the matter in some detail and I came to the con- clusion that there was no reason to lay a charge," said the veter- an Detective. "We usually look for some intent in these matters, and I could find none, nor could I see any chance of a con- viction." Det. Mooy said that any citizen who feels that the police are not taking a complaint seri- ously or investigating a matter vigorously enough is free to take it to a Justice of the Peace. Ms Ewart said she took the matter to a Justice of the Peace after an officer told her that option was avail- able to her. Ms Ewart, the com- plainant in the matter, was in court on Monday accompanied by Mr. Kemp. Both declined to say whether they were in court to follow pro- ceedings on the Lishman charges. Mr. Kemp initially told reporters "it's none of your business why I am here." Ms Ewart later said in an interview that she intended to be in court . for the matter, and that es Lishmans with theft Mr. Kemp was there as a friend to support her in the matter. Bill Lishman said he could not comment on the matter beyond the fact that neither he nor his wife had committed any offense. "We will defend these charges," said Mr. Lishman "The whole thing is ludicrous." The charges against the Lishmans are two counts each of theft under $5,000, and two counts each of posses- ~ sion of stolen property. The civil action from which the charges allegedly stemmed is still ongoing, said a source.
