"This family has been reduced by 50 per cent... by something that could have been avoided, easily avoided," Mr. Polley said. "If Mr. Brooks did not drink and drive, if he didn't drive, we wouldnt be here today. Family and friends would not be suffering; this tragedy would be avoided." The court also heard that after the accident, Ella Fensom was in a coma for more than three months, and, upon waking, had to be told that her son and sister had been killed. After his 45-minute address, the Crown asked for jail time of between five and seven years with a license sus- pension of up to 10 years. Defence lawyer Marshall Sack continued with the argument, heard during trial, that Mr. Brooks only crossed the centre line because he was trying to avoid hit- ting a fox. He said that if the defendant had to go to prison for the two deaths, he should be sentenced to 12 to 15 months at a reformatory. "He had three, four beers perhaps and was driving home with his wife," Mr. Sack told the court. "His driving appeared to be fine -- perfectly within the confines of his lane -- and his speed was appropriate when something occurred to make him go in the other lane." Mr. Sack also reminded the judge that his client had only had a few beers, and was not the kind of person who would spend a night in a bar and then drive home. "This (sentencing) is not about retribution or revenge." Moments after Mr. Brooks was sentenced, hand-cuffed and taken away, Wendy Gillott, sister of Brian Fensom and daughter of Murray and Ella Fensom, let out a sigh of relief. "It's over, almost three years later... it's gone on way too long, but now we can get on with our lives now," she said. : The sentence will never bring back lost family mem- bers, she said. a. Mr. Fensom, 45, and Ms Humphrey, 69, of Scarborough, were pronounced dead at the scene. Murray and Ella Fensom, both passengers in the Cherokee, were critically injured in the accident. The Fensom family was headed to Eagle Lake to close Brian's trailer for the winter. Police officers and paramedics who attended the scene testified that they detected a strong odour of alcohol on Mr. Brooks. And during the trial forensic toxicologist Dr. Michael Corbett told the court he estimated the accused's alcohol level at the time of the accident anywhere between 117 and 165 mg per 100 millilitres of blood. 1.
