Durham Police report that a 49-year-old man attended Port Perrys 26 Division station around 3 p.m. on Dec. 5. He told police that his 48-year- old wife had been "very agitated and aggressive throughout the day" and that she had come after him in their home with an axe. When the victim got into his vehicle to leave their home, she struck the car with the axe, breaking the rear win- dow, say police. Officers arrived at the Old Simcoe Rd. home shortly before 5 p.m. that day, and, after knocking on the door several times, noticed the accused look- ing out the kitchen win- dow while only wearing a blanket. The officers were invit- ed into the home, and upon looking around the house noticed a razor blade and knife on the coffee table near the accused. Lawyer's Opinion? Differences and Consumer Consequences. In my last column I wrote about Title Insurance and promised I would write in this column about some of the differences between Title Insurance and the way lawyers have traditionally protected home buyers from title problems. Title Insurance is a new tool for the real estate lawyer in protecting the home buyer from these problems, creating smoother closings and contributing to the home buyer's peace of mind. Title Insurance is, as the name implies, a kind of true insurance. Similar to car insurance, life insurance or home insurance, Title Insurance, compensates policy holders for defined losses should they occur. Title Insurers like all insurance companies are in the business of charging a fee or premium for assuming a risk. It is the willingness on the part of the Title Insurer to assume risk that creates the new opportunities to solve potential problems in real estate purchases, mortgages and sales. Although the time honoured Ontario practice of having a lawyer assure a home buyer that the title 1s good, is similar to insurance it is not true loss based insurance. Lawyers, unlike Title Insurance companies are not in the business of taking risk. Indeed both in terms of lawyer's training and what a client expects of his or her lawyer, risk must be avoided and minimized to the greatest extent possible. Although risk avoidance is proper, good real estate lawyers learn that in order to close many home buyers' purchases, sensibly and smoothly, some risk taking on the part of the lawyer is necessary. The lawyer in giving an opinion on title, must distinguish between real problems and what one well known real estate lawyer refers to as "warts on title". Having said that, even good experienced real estate lawyers are not prepared to take real risks in assuring buyers that title is good. This 1s where Title Insurance often comes to the rescue. Title Insurers rightly and properly assume reasonable but real risk. Title Insurance therefore becomes a way for lawyers to solve potential title problems casily at reasonable cost and get to closing with peace of mind for all parties.
