The case is not expected to come to trial before next fall at the earliest. The court's decision could be appealed to the Supreme Court Legal sources said that if Reitman's wins its case, it is certain that other importers af- fected by the surcharges will seek repayment. No exact figure is available of the total amount collected un- der the surcharges. For the first 11 months of last fiscal year to the end of Febru- ary--one month before the sur- charges were listed--total cus-' toms duty collections were $111,- 000,000 higher than a year ear- lier. The surcharges are re- sponsible for most of the in- crease, although a gain of some $250,000,000 during the period in the flow of imports also pro-' duced higher customs revenues. The legal angument over the validity of the surcharges likely will be a complex one, based on a'claim that the cabinet orders were not authorized by law. Last June the government took a round-about way of im- posing the surcharges. Under the Customs Tariff Act it raised duties on the imports involved up to the level of the 'general tariff'--a rate higher than the duty applicable to most of Can- ada's imports.
