IN WHITBY COURT | Youths Admit 6 Charges Each WHITBY (Staff) -- Two Osh- @wa youths were convicted on a number of fraud and forgery charges Tuesday in Whitby Constable D. Crown Attorney Bruce Affleck told the court the two youths were part of a gang which ob- tained blank cheques from the Auto Workers Oshawa Credit Union and roamed Ontario pass- ing the fraudulent cheques to service stations. Their plan, he said, usually was to pay a $3.50 gasoline bill with a $35 cheque and divide the change between them. Shabatura's attorney, John Humphreys, said the youths had acted in a "'rash of foolishness"', | and had been influenced by old-} er members of the gang. They were willing, he said, to make complete restitution to the serv- ice stations. Mr. Affleck Said he consider- éd it poor justice to allow a man of means to get off with making restitution while a poor man has to go to jail. Seven days in jail and a six- months suspension of his licence was handed down to Russell Garnet Pyear, 44, of 19 Strath- connor drive, Belleville, when he pleaded guilty driving. Pyear, he said, smelled of al- cohol and was in a highly con- fused state of mind. When asked by Onlock if he knew he was in the wrong lane Pyear replied, 'No, but if you say so I probably am." Mr. Affleck said Pyear was convicted of careless driving in 1963 : A Scarboro man, Harold Rob- inson, 61 Matindell avenue, was fined $100 and costs with the al- ternative of 15 days in jail, and had his licence suspended for three months when he pleaded guilty to impaired driving. Former Toronto Chief Magis- trate Thomas Elmore, who de- fended Robinson, said the ac- cused had been a truck driver for 12 years without committing an offence. Theft of a leather footstool cost Harold Ross Johns, 22, of 161 King street east, Oshawa, a six months' suspended sentence. Johns stole the stool from a Whitby furniture store and said he didn't know why he took it, "except perhaps stupidity". Ernest Martin, 27 Thorncroft crescent, Ajax and William G. Lawson, of Barr Church street north, Pickering, were both fined $25 and costs or five days in jail for failure to file income tax returns.
