But when Judge McClemens let go virtually free a 17-year- old who had kicked another youth to death in the street, the public felt justice had not been done. Almost every newspaper in Australia's major cities joined in a chorus of protest. At a time when police are fighting a desperate battle to stamp out violence in the streets by hoodlums, such leniency seemed outrageous. So intense was the feeling that the New South Wales attorney - general ordered an appeal against the sentence, which \means_ three judges now will decide whether Judge McClemens' ruling was fair and just. The case arose from the death of Raymond Dixon, a slightly- built, 98 - pound youth of 17, who left a discotheque with his 16-year-old girl friend. They were standing at the street cor- Mer waiting for a bus when @ One of the youths, Phillip Cuthbert, a muscular 140-pound- er, admitted in court his gang was just out looking for a fight. Cuthbert picked on Dixon. First, he knocked Dixon to the ground, then jumped on his head. He stepped back 12 feet and took a running kick at Dixon's head. Dixon, who never fought back, died later in hospital. Basis of the defence case was that Cuthbert never intended to kill and his lawyer produced Cuthbert's shoes as evidence. They had soft uppers with rub- ber soles. "These aren't the type of shoes a youth intending to kick someone to death would wear," he said. The judge agreed and said he was convinced Dixon's death was unforeseen by Cuthbert. He found him not guilty of murder but guilty of manslaughter. He put him on a good - behavior bond for three years, which means Cuthbert goes free. In the uproar, the dead boy's father said: "The judge was weak. He didn't do his job. I'm not just after revenge. I'm just trying to protect other people from this sort of thing."
