WIN FREE OF LOTTERY TICKETS Our Gift You WINTARIO SWEEPSTAKES Timbrell replies to Hydro editorial Hydro facilities will be controlled by province To The Editor of Ihe Herald Your editorial of May entitled Hydro Lb not above the law has been brought to my attention I must say it causes me concern and I believe it reflects a great deal of misunderstanding regarding the current problem of the zoning by laws in Hills I would like to review he cast based on the records of he ministry of energy which in dlcate 1 By law as amended by By laws 11 and passed by he Council of former Corporation of the Township of and presently in force in pari of he Town Hills does not provide or he construction of any works or readings or Ontario Hydro the town In December 1973 the Council of the Town of Halton Hills was requested to amend the bylaws to permit the erection of two distribution stations to serve the Town of Hills Subsequently Ontario Hydro applied for an amending order to the Ontario Municipal Board directing the Council to pass the amending bylaw 3 After a public hearing held on July the Ontario Municipal Board reserved Its rulings to permit the Council to pass the amending bylaw which was done on October 1974 and allowed the distribution stations to be constructed On June 1974 the Corporation of the Town of Halton Hills passed Bylaw which is a zoning bylaw Ontario Hydro pointed out thai Zoning Bylaw did not include a public utility exemp tion clause Ontario Hydro applied to the Ontario Municipal Board for relief from this bylaw fl On April 1976 the Ontario Municipal Board refused to grant the requested relief You have probably noted hat the Council mode the i amendments to bylaws when distribution hod to be built to serve the people of Hills Tne transmission line now under question is a kV line connecting the Bruce Generating Station to the Milton Transformer Station This transmission line is for the in transmission supply of he province including the citizens of Hills Clearly it is established that facilities built by Ontario Hydro for he service of the entire province must be under provincial control Your comment on the respect with which the Ontario Municipal Board is held is appreciated but 1 believe there is a lack of understanding about Its authority The is not supreme as there are provisions for appeal from an decision to the Ontario Cabinet Ontario Hydro therefore isnotabovcthclawosyou suggest rather it is following procedures which are established by the Legislature Ontario Hydro does not descr the derision of your editorial or being pointed out to as a villain in this matter Ontario Hydro has for over seventy years served the people of Ontario well and built an efficient electrical power system for the province They arc subject to the policy direction of the provincial government elected by the people of Ontario and the policy must be formed with the interest of all citizens of Ontario in Minister of thought of calm and
