February Herald staff writer Chief County Court Judge William Colter reserved his decision in the hearing into charges of discreditable and neglect of duty against two Halton Regional Police officers in connection with an alleged incident In the transporting of prisoners lost August Judge Colter said he expect to have a decision with which he must Include in writ reasons by the end of February at the latest and possibly within the next two The two officers Constables Arnold Vanclief and Raj Swa were charged with discreditable conduct and of duty after members of a group of prisoners the two officers transported lo Metro West Detention Centre ained that the heat was on In the von ins pit of tempera in excess of 90 degrees that day that their handcuffs were fastened too tightly and that the erratic driving of the van caused them be thrown about In the back FINAL SUBMISSIONS The lawyers David McCon representing the Regional Police Commission and William rep resenting the two officers made their final to the court Monday Mr MacDonald said the pol ice force Is a paramilitary organization in that the men arc under orders and they don have any choice to say I don think I II do that today I wait til next week when It cooler It would be unreasonable for theolficerstostoponHwy or on Carlingvicw Drive be cause both areas are quite open and when carrying vc prisoners In the back four of whom have previously esc aped custody the security risks are increased Mr MacDonald said It was only shortly before the van arrived at Metro West that the two officers became aware that the heat in the back must be oppressive he said At that point it was pointless turn back or radio for help The most reasonable thing was to proceed as quickly as possl to Metro West Mr MacDonald said there was a point of no return on the trip and once past that point with Highway being more or less a limited access high way there just no place you can stop and buy your prisoners ice cream he said The two officers had no reason to be aware of what the ions In the back of the van were like Mr MacDonald said because they had never ridden in the back seems to indicate he Hug that Griff Branch one of the prisoners fainted just before or as the van was arriving at Metro West Detent Ion Centre GOT WORSE It would seem the heat got worse and worse and worse as the trip proceeded and Mr Branch succumbed to heat prostration The prisoners tea I If led that the heater In von was on Mr MacDonald said but Professor Alexander Allen associate professor of median ical engineering and mechanics at the ty of Toronto said the heater was merely recirculating hot air There was some confusion over the fact that Staff Serge ant Eric Bullock testified that the van fan was working aft the incident while a mech said fan had been disconnected before the incid Judge Colter said he understand why someone would reconnect the fan but there is no evidence either of Ihe officers was Invo Ived If the heater was on far the prisoners it was on for the officers as well Mr said There is no doubt If the heater was on that a criminal act Mr MacDonald reminded the court that Professor Allan said communications win i the front and the rear of the van would have little or no effect on the In back of the van He also said the heater have to be on In order to create the kind of conditions existing in the back of the van that day Mr asked Judge Colter to act in consideration of guilt beyond reasonable doubt as Is done in criminal matters particularly in light of the effect a conviction would have on the officer futures and careers Mr McConachle summing up the cose for the commission said there were a number of sins of and com mission August 14 which add up to neglect of duly and discreditable conduct Mr McConachle suggested the court that by the definition of the two charges finding guilt on the charge of neglect of duty would necessitate a finding of guilt on the charge of dlscrcdl table conduct since the of duty would bring disre pute to the force The public has have trust in the force and the chief must have trust in the that they will perform their dut Mr McConachle said Mr McConachle said that all the prisoners having had previous encounters with the judicial system were ienccd with regard to the courts and prisoner trans perls Ail prisoners tied that they had never been involved in an dent like this before he said CRIMINAL RECORDS As far as the credibility or the witnesses was concerned Mr McConachle said Just because Ihese people have records I mean their evidence could be counted Mr said there is no question that three of the inmates ned the cuffs too tight However there no that the two officers checked ensure such was not the cose He added that there was also a serious breach of security In not putting leg irons on Carley on the trip back to Metro West In light of Informs Hon received that a gun might be smuggled to him and an escape attempt made Instead Mr Carley was only handcuffed to one prisoner who Constable Vanclief testifl earlier had the most to lose if he tried to escape Why they cuff him In three or six s for additional security Mr McConachle asked Mr McConachle said that Constable Vanclief action in leaving the van door open at Maplehurst Correctional Cent re while a prisoner was being token Inside was also a breach of security since in a fairly open area and he added that no evidence had been entered siuuest that there is any security on grounds of the centre Mr McConachle said thai although a number of officers had that they had problems with the von Staff Sergeant Bullock had said he preferred driving the van to driving a cruiser He suggest cd that the failure of the officers to report the problems they were having with the van amounted to neglect of their duty Mr McConochie suggested that the removal of the prison ers personal belongings could have been carried out In a more humane and court fashion and that It was Inhuman o lump all their bdong in one pile rather than keeping them separote Any aura of hostility bet ueen prisoners and the officers was largely due to the actions of officers he said TWO INCIDENTS or punishment on conviction of these offences ranges from a reprimand to dismissal Judge Colter has the option of finding the era guilty of a lesser offence if he chooses in which case Mr McConachle might make a submission at that lime BUSINESS DIRECTORS Levy criticizes municipal complex funding A motion to allocate lot levy funds for the proposed of the towns municipal headquarters on Trafalgar Road which breezed the general committee last week aground briefly when It came up for council approval Monday night Coun Harry Levy absent for the discussion lost week that resulted in a general committee recommendation for the allocation of funds reminded his colleagues of the public outcry two years ago that virtually forced council to shelve its more elaborate plans for the municipal com Any further expansion plans Coun Levy contended should be kept on the shelf a while longer at least until priorities for municipal spending are organized with the adoption of 1979 budget and capital forecast this spring COUNCIL APPROVED Council nevertheless proved the committee mendatlon and a bylaw which will see up to 000 in 1979 lot levies and In 1980 levies allocated a special reserve fund for proposed centralization of all municipal departments within expanded quarters at the Trafalgar Road site This is just another way of getting something that council two years ago turned down after a great deal of discus input and frustration Coun Levy charged I feel council is moving in the wrong direction The Ward representative reelected to council in De cember after a twoyear ab sence assured his colleagues that his opposition to the pro posed expansion has nothing to do with the location of the site Coun Roy Booth has suggest cd with a grin that Levy might to see llu headquarters situated in his own ward These funds could be of much more benefit to the town as a whole Levy main This bylaw lies up all 1979 funds unless previously committed TWO YEARS Coun Mike Armstrong com that the council of the day wo years ago knew exactly what it was doing while the council of three years ago did not He admitted that he was a member of both It would be sheer folly if we don t proceed th this now he said noting that lot levy funds are surplus and arc held opart from the town capital budget funds Coun Waller called cxpans on proposal the only sensible way to draw all muncipal staff together but Coun Marilyn contended that the matter should be deferred until the town budget is struck My priori don I lie with pal facilities son she said Id like see the funds on something more people can utilize Lets face it we re going to need the expanded tors sooner or later Coun Miller claimed In response to Coun Levy assertion that the expansion may be needed n another ten years Booth noted that the decision to centralize mun departments was made about vc years ago while the project Is not likely to get underway for another four years There your years he told Coun Levy Robert H
