SECTION THE HERALD February Mi Page Accident 1 victim awarded damages By MAGGIE HANNAH MILTON The victim of an accident at the Acton Fall Fair and his family have been awarded and costs by a district court judge I found Myrna Walker and Wulkerlee Farms Ltd or I to be negll- and responsible for injuries Roland Height suffered in an accident in the heavy horse ring at Acton Fall Fair in September 1982 Judge Quintan sold the location of the accident was the key to respons ibility for it and had he found Height to have been in the light horse ring at the time of the accident he would have considered Height to be the author of his own misfortunes Evidence given to the court during the trial in midJanuary showed Mr Height was assisting the heavy horse judge by bringing out the ribbons for presentation to the winners of various events I After weighing the evidence Judge Quintan concluded Mrs Walker was negligent In the operation of her horse and bike having overrun the light horse ring and entering the heavy horse I ring injuring Mr Height The judge said he be lieved Mrs Walker was convinced she had her horse under control at alt times and was convinced in her own mind she did cross the line be tween the light horse ring in which she Was competing and the ad jacent ring in which Mr Height was working as a member of the Acton Agricultural Society The facts the judge concluded do not agree with her belie ft Judge found problems in accepting testimony by several members of the Agricultural Society who testified on Mrs Walkers behalf He said recollections by horse ring announcer Jesse were not in accordance With the generally accepted evidence or the other witnesses He also had difficul ty accepting the vers ion of where and hDw the accident took place as presented by Bob Mar shall also a Fair board member His most severe en tic ism of Mrs Walkers witnesses was aimed at Fair board member Bill Thompson It would appear tome that Mr Thompson de cided that Mr Height was at and has conveniently recon structed the placement of the pylons separating the two rings to confirm that point Judge an said The awarded Mr Height 6419 for special damages loss of Income and general damages plus prejudge ment interest at per cent from October 1963 Mr Heights wife Peg received plus Inter est and their son Tim received plus interest Mr Height said he was satisfied with the judge ment adding he had only asked for in lost income originally but when Mrs Walker ed to admit the accident was her fault he had been forced to go to court and sought additional
