Stull appeal of Site Alteration Committee decision denied By Kathryn Boyle kboyle@theifp.ca After over four years of discussions, the Stull property located on Eighth Line will not get its exception to the site alteration bylaw. At the Feb. 1 Council meeting, property owner Sally Stull appealed the previous decisions of the Town-appointed committee, Site Alteration Committee (SAC) in November and Council in December to the general committee and a room filled with concerned residents opposing the Stull application. "I would like to state, for the record, that this is not truly an appeal because it lacks procedural fairness, as the site alteration bylaw... directs the appeal back to the same council which made the decision in the beginning," she stated. "Council and the committee denied the application... despite the application satisfying every requirement of that site alteration bylaw, including purpose, intent and technical requirements, both on site and off. "The long-term land use of the property and its rehabilitation is in the public interest as it is related to agricultural land rehabilitation and the use of surplus soils," she said. "This initiative is supported by provincial, regional and local policy and legislation and has no technical barrier to completion, other than temporary truck nuisance." Stull said she is requesting Council to exempt the property from the bylaw to fill a former gravel pit with 72,000 truckloads of fill, subsoil and soil over three to five years to create an 8.8 hectare parcel of productive farmland. After meeting with SAC on numerous occasions, the committee denied the Stulls' application in November. In its ruling, SAC had a long list of reasons to deny the application including that potential for fill to contaminate a nearby aquifer, would impact the roads and neighbours, and is unlikely to improve the overall fertility of the site. However, Stull said the land was classified as Class 1 farmland prior to excavation. "There is no reason to suggest it cannot be productive, as this is the intent of the site alteration bylaw and this has been undertaken many places before and is undertaken by ourselves currently as a business," she said.
