TAKE NOTICE that the Council for The Corporation of the Town of Caledon enacted BL-2013-119 on December 9, 2013, to adopt Official Plan Amendment (OPA) No. 236 in accordance with Section 17 of the Planning Act, R.S.O. 1990, c.P.13. The Amendment applies to the lands known as Part of Lots 27 and 28, Concession 2 WHS (CAL), Town of Caledon, Regional Municipality of Peel. OFFICIAL PLAN AMENDMENT: The purpose of this Amendment is to re-designate lands to "Extractive Industrial "A" Area" and "Environmental Policy Area" to permit the development of an above-water-table sand and gravel extraction operation. BASIS OF THE AMENDMENT: The basis for this Amendment is contained in Planning Report DP-2013-111, as adopted by Council on December 9, 2013. This Official Plan Amendment only affects lands located within the proposed licence boundary. This Amendment is to permit the development of an above-water-table sand and gravel aggregate extraction operation (pit) on lands identified as being within the Caledon High Potential Mineral Aggregate Resource Area (CHPMARA), Aggregate Resource Lands as shown on Schedule "L" to the Caledon Official Plan. The proposed development of a sand and gravel pit on the subject property is consistent with the overall goals, objectives and policies of the Caledon Official Plan. Mineral aggregate resource is an important component of the Town's economic base. The Town is mandated to protect its mineral aggregate resource for possible use and manage the resource with consideration for social, community and environmental issues. The following studies have been prepared in support of this application: • Aggregate Resources Act Site Plans; • Planning Report • Level I and II Natural Environment Assessment • Hydrogeological Assessment (including resource evaluation) • Traffic Impact Assessment and Site Access (Sight Distance) Review • Noise Impact Assessment • Visual Impact Assessment • Archaeological Assessment, Stages 1 and 2 • Cultural Heritage Resource Assessment • Air Quality Assessment If you wish to appeal the decision of Council, a Notice of Appeal must be filed with the Clerk of The Corporation of the Town of Caledon no later than January 9, 2014. A copy of an appeal form is available from the Ontario Municipal Board website at www.omb.gov.on.ca or by contacting the Town Clerk at 905.584.2272. x.2366 A NOTICE OF APPEAL MUST: 1. be inwriting; 2. set out the reasons for the appeal and the specific part of the Official Plan Amendment to which the appeal applies; 3. be accompanied by the Ontario Municipal Board fee in the amount of $125.00, which can only be paid by certified cheque or money order made payable to theMinister of Finance, Province of Ontario; and, 4. be accompanied by the Town's fee in the amount of $150.00, which can be paid by cheque, payable to the Town of Caledon. The Official Plan Amendment is exempt from approval by the Minister of Municipal Affairs and Housing. The decision of Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal. Only individuals, corporations or public bodies may appeal a decision of the municipality or planning board to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
