This will determine whether you are in the Small Claims Court or the "higher" Superior Court of Justice. (4) Go and get some legal advice. This will help you decide whether to take action or not, and, if you are going to take action, how to move forward with that. (5) Finally, do not delay. There are likely to be some time limitations on commencing the lawsuit. If you miss those time limitations, then you may be "statute barred", i.e. out of time from taking action.
