And should I try it? Mediation is a form of alternative dispute resolution, or "ADR". The mediator is a third party who assists the parties to negotiate and reach a final agreement. The mediator is not a decision-maker, but rather someone who facilitates a discussion toward resolution. Participation is typically voluntary, although some legal jurisdictions have mandatory mediation, like Toronto. The mere fact that parties are willing to mediate usually means they are both ready to seriously settle their dispute. I mediate cases in all the different areas of law I practice: family law, employment law, civil litigation, personal injury, etc. There are many advantages to mediation, including: 1. The process is private and confidential; 2. You can chose a mediator who has special expertise and experience in the area being mediated; 3. Mediation can be scheduled at any time instead of waiting months or even years for a trial; 4. Instead of taking days or even weeks at trial, your case can be resolved at mediation in a day or less; 5. Parties have much greater control over the outcome at mediation - at trial, the judge or jury makes the decision; and 6. Because parties work together to reach an agreement, there tends to be a greater commitment to respecting the agreement, especially in family law matters. So, if you want to settle your dispute sooner, participate in the outcome and save some money, yes, you should mediate! Have a great weekend. The dealership then asked the public to vote on their favourites. Christ the King was voted the winning school, and will receive a $600 donation to its art department. Georgetown Toyota General Sales Manager Gord Russell said it was difficult to pick a winner due to the quality of the submissions and the three had garnered hundreds of votes for the contest running on Georgetown Toyota's Facebook page.
