Hein Litigation Lawyer LITIGATIONlegal matters What information do I have to produce in a legal proceeding? First, I am pleased to announce that, as of July 1st, 2015, the law firm of Lockyer & Hein LLP ("L&H") succeeded the law firm of McCabe, Filkin, Garvie & Hein LLP ("MFGH"). L&H will continue providing legal services in MFGH's office in Brampton, but also has an office in Caledon East. Regarding production of documents, the general rule is relevance; if it is relevant it has to at least be disclosed, and possibly produced. The threshold in terms of what is relevant is pretty low. In the Superior Court of Justice, parties have to complete and exchange Affidavits of Documents. The affidavit typically has three schedules: "A", "B" and "C". Schedule "A" is all relevant and producible documents, i.e. you have to give a copy to the other side. Schedule "B" is a list of all relevant but non-producible documents. A document may not be producible because, for instance, there is a privilege that attaches to it. Schedule "C" is a list of any documents you had, but no longer have because they were lost, or there was a flood or fire, etc. Our legal system is based on full disclosure of what is relevant.
