If the marriage is less than 5 years the spouse owning the matrimonial home can claim it is "unconscionable" his or her spouse receives ½ the value. "Unconscionable" is not the same as just unfair. To be unconscionable dividing the matrimonial home equally must be extremely unfair based on the facts of the marriage. All is solved by a marriage contract where both parties decide what is fair in regard to a matrimonial home owned by one party prior to marriage.
