The first thing that must be determined is who is the owner/occupier of the area where you fell. If the fall occurred on municipal property special considerations apply that are unique to the municipality. First you must within 10 days of the fall provide written notice of the claim sent by registered mail to the clerk of the municipality. Failure to do so could mean that you may not be able to make a claim against the Municipality, unless there is a reasonable excuse for not doing so and the municipality is not prejudiced. Secondly it must be established that the Municipality was grossly negligent in maintaining the sidewalk. If the fall occurred on private property then the Occupiers Liability Act applies. This means that the owner and occupier of a property owes a duty to take such care as in all circumstances of the case is reasonable, to make sure that persons entering onto the property are safe. What this means depends on the facts of each case. Wherever the fall occurred it is important to take pictures of the area as soon as possible because this is Ontario and we all know the weather changes occur frequently.
